Bristol Street) <br />RECOMMENDED ACTION <br />Adopt a resolution approving Conditional Use Permit No. 2025-01 as conditioned. <br />EXECUTIVE SUMMARY <br />Cotti Foods California, Inc. (Applicant), representing Wendy’s Restaurant (Wendy’s), is <br />requesting approval of Conditional Use Permit (CUP) No. 2025-01 to allow the after-hours <br />operation for a new Wendy’s eating establishment proposed at 2600 South Bristol Street. <br />Pursuant to Section 41-412.5 (d) of the Santa Ana Municipal Code (SAMC), eating <br />establishments open at any time between the hours of 12:00 a.m. and 5:00 a.m., and <br />located within 150 feet of residentially used or zoned properties (measured from property <br />line to property line) in the Planning Shopping Center (C4) zoning district require <br />discretionary review and approval of a CUP by the Planning Commission. Specifically, <br />the applicant is requesting approval of after-hours operations, Sunday through Thursday, <br />from 6:00 a.m. to 1:00 a.m., and Friday and Saturday from 6:00 a.m. to 1:30 a.m. The <br />after-hours operations is proposed only for the drive-through services, as the indoor <br />dining area is only proposed to be open from 6:00 a.m. to 10:00 p.m., seven-days a week. <br />Staff is recommending approval of the Applicant’s request, as it would allow for enhanced <br />operations at the commercial center and incentive the revitalization of an existing <br />commercial building and drive-through lane, located on a major thoroughfare and <br />prominent intersection. Moreover, the project’s site is located away and physically <br />buffered from sensitive land uses, the project complies with all applicable City standards, <br />supports the City’s General Plan goals and policies, and the proposed operational <br />standards would ensure that the Applicant’s request would not negatively affect the <br />surrounding community. <br />
