CUP No. 2019-19-MOD-1 & VAR No. 2019-2-MOD-1 – 360 Adult Day Care (1800 North <br />Bush Street) <br />January 27, 2025 <br />Page 4 <br />4 <br />7 <br />5 <br />8 <br />Project Background <br />The site was originally developed in 1989 with a two-story 10,800-square-foot building <br />that has since been occupied by various professional and medical office tenants. On June <br />24, 2019, the Planning Commission approved CUP No. 2019-19 and Variance No. 2019- <br />02, which permit the operation of an adult day care center on the first floor of the building, <br />accommodating up to 40 participants, and a parking deficit of twenty-seven percent (27%) <br />which equates to 11 spaces. <br />The adult day care center is still in operation and is now proposing an expansion to <br />accommodate additional participants and staff, as the existing unit has the capacity to <br />support additional individuals, in order to meet the increasing need for care and maintain <br />the business in operation. Throughout its operation, the site, including the adult day care <br />center, has not received any complaints related to noise, parking, or circulation concerns. <br />Project Analysis <br />Conditional Use Permit <br />Conditional Use Permit (CUP) requests are governed by Section 41-638 of the SAMC. <br />Modifications to existing CUPs may be granted when it can be demonstrated that the <br />proposed project meets the findings contained in Section 41-638(a)(1)(i)-(v). If the <br />required findings can be made, it is appropriate to grant the CUP; however, if the findings <br />cannot be made, the request must be denied. Pursuant to Section 41-313.5 of the SAMC, <br />adult day care facilities located in the P (Professional) zoning district are subject to <br />discretionary review and approval of a CUP by the Planning Commission <br />Based on the project’s operational details, staff recommends approval of the Applicant’s <br />request for a CUP modification. The proposed project responds to a growing community <br />need by expanding the center’s capacity to provide services to a larger segment of the <br />aging population and their families who live or work in the surrounding area. The proposed <br />increase in participant capacity is not expected to result in the maximum on-site <br />occupancy of 199 individuals at any given time, as previously described. Rather, the <br />modification would provide the adult day center with operational flexibility to extend its <br />services beyond the current limit of 40 participants. The existing limit has primarily been <br />constrained by the availability of on-site parking, and the proposed modification seeks to <br />alleviate this limitation without adversely impacting the surrounding area. Moreover, the <br />expanded participant capacity is not anticipated to generate activities that would disrupt <br />the existing character of the neighborhood. The center’s daily operations will remain <br />consistent with current practices, which include offering two four-hour programming <br />blocks throughout the day. During each block, participants are provided with meals and <br />engage in various structured social and physical activities designed to enhance their well- <br />
