Exhibit 2: Clarifications to ZOA No. 2024-02 <br />2 <br />1. Notice of Amortization and Termination of Use. The Executive Director <br />of the Planning and Building Agency, or designee, shall give notice by <br />certified mail of the date upon which an amortization period will end to <br />each owner of record whose property, or use of property, is not in <br />conformance with the regulations of this Article, in those instances <br />where an amortization period has been determined pursuant to this <br />Article. Such notice shall be sent within ten (10) days of the termination <br />of any appeal period the determination of the Hearing Officer. If the <br />amortization period ends before or less than six (6) months after <br />providing such notice, the notice shall be given that the amortization <br />period in each instance shall be not less than six (6) months from the <br />date the notice is sent. The notice shall set forth all pertinent provisions <br />of this Article, including the declared purposes thereof and the approved <br />amortization term. Failure to send notice by mail to any such owner <br />where the address of such owner is not a matter of public record shall <br />not invalidate any proceedings under this Article. The Executive <br />Director of the Planning and Building Agency, or designee, shall be <br />authorized record a Notice of Amortization Term & Termination of Use <br />with the County Recorder, as provided for in California Government <br />Code Section 27201(a). <br />The following changes based upon community feedback received at the Transit Zoning <br />Code community meeting held on March 3, 2025, shall be included in the draft Ordinance <br />recommended by the Planning Commission for City Council consideration: <br />6. Ordinance Page 24, Subsection (l) of Section 41-2008 (Operational Standards), which <br />proposed prohibiting automobile servicing on Sundays shall remain unchanged and <br />reflect the existing standard as shown below: <br />(l) Automobile servicing uses including nonconforming establishments, shall comply <br />with the following operational standards: <br />(1)No automobile servicing shall be conducted before 7:00 a.m. or after 8:00 p.m. <br />Monday through Friday and before 10:00 a.m. or after 8:00 p.m. Saturday and <br />Sunday. <br />(2)All work shall be conducted inside an enclosed structure. <br />(3)Outdoor or overnight vehicle storage is not permitted. <br />7. Ordinance Page 27, Subsection (k) of Section 41-2009 (Operational Standards for <br />Nonconforming Industrial Uses), which proposed imposing new operational hours <br />shall be removed in its entirety, as the operating hours imposed on all uses under <br /> <br />Planning Commission 1 – 11 3/6/2025 <br />
