<br />Ordinance No. NS-XXX <br />Page 4 of 49 <br /> <br />(35)Rehabilitation, enlargement or exterior structural alterations of any <br />nonconforming structure or structure occupied by a nonconforming use, except <br />for structures occupied by single family and two-family dwellings, may be <br />rehabilitated made as follows: <br /> <br />a. Rehabilitation, limited to structural or non -structural alterations without any <br />building expansion and without any intensification of a nonconforming use, <br />is permitted if: <br /> <br />1. The operational standards contained in sections 41-2008 and 41-2009, <br />as applicable, of this Article are met. <br /> <br />1. 2. All signage on the structure and the site on which it is located is brought <br />into conformity with the signage requirements of this Chapter , as <br />approved by the Executive Director of the Planning and Building Agency, <br />or designee. <br /> <br />2. 3. All outdoor storage is screened by a solid screen wall not to exceed eight <br />(8) feet in height. Outdoor storage shall not exceed the height of the <br />screen wall. <br /> <br />3. 4. There shall be no increase in the number of dwelling units unless the site <br />on which the structure is located complies with the off-street parking and <br />open space requirements of this Chapter. <br /> <br />4. 5. Architectural massing, features and detailing shall be modified to bring <br />the structure into closer compliance with the architectural standards of <br />this Article code, as approved deemed appropriate by the Executive <br />Director of the Planning and Building Agency, or their designee. <br /> <br />b. Rehabilitation may include expansion of floor area without intensification of <br />the nonconforming use when the total floor area of all expansions occurring <br />in any five-year period does not exceed ten (10) percent of the floor area as <br />it legally existed as permitted and constructed as of April 15, 2025 at the <br />beginning of the five year period, provided that the following standards <br />conditions are met: <br /> <br />1. The existing use is not a nonconforming industrial use. Nonconforming <br />industrial uses may not be expanded. <br /> <br />2. The operational standards contained in Section 41-2008 are met. <br /> <br />1. 3. All signage on the structure and the site on which it is located shall be <br />brought into conformity with the requirements of this chapter Chapter as <br />approved by the Executive Director of the Planning and Building Agency, <br />or designee. <br /> <br /> <br />Planning Commission 1 – 16 3/6/2025 <br />
