CEQA Class 32 Exemption – 400 W Warner Ave <br />April 7, 2025 <br />Page 3 of 10 <br /> <br /> <br />According to the City’s Municipal Code Chapter 41 Division 18 Section 41-472.5(s), indoor sport facilities are <br />conditionally permitted in the M-1 zone, subject to the development and operational standards set forth below. <br />According to Chapter 41 Division 18 Section 41-482, in addition to the standards of the M-1 district, indoor <br />sport facilities shall comply with the following development and operational standards: <br /> <br />a) All business activities shall by conducted and located within an enclosed structure. <br />b) Any outdoor storage of equipment or materials shall be fully screened by a decorative masonry block <br />wall. <br />c) No indoor sport facility shall operate before 7:00 a.m. or after 10:00 p.m. on any day of the week. <br />d) Ancillary uses including: meeting rooms, snack bars and equipment rental or sales are permitted within <br />an indoor sport facility provided that their gross floor area of the ancillary use does not exceed twenty <br />(20) percent of the total building area. <br />e) Ancillary uses shall operate in conjunction with the primary recreation use, and shall maintain the same <br />or fewer hours of operation. <br /> <br />D. Surrounding Land Uses <br />Surrounding land uses include industrial, industrial/flex, residential, and institutional within the City of Santa Ana <br />limits. Specifically, the Project site includes single-family residences and Esqueda Elementary School to the north; <br />industrial uses to the south; commercial and industrial uses to the east; and industrial uses to the west. <br />Surrounding land uses are zoned R-1, C-5, and C-2 to the north; M-1 to the south and west; and C-1 and M-1 to <br />the east. The Project is consistent with the General Plan and zoning and, therefore, would complement <br />surrounding development. <br /> <br />III. CEQA CATEGORICAL EXEMPTION <br /> <br />A. Class 32 Exemption <br />CEQA Guidelines Section 15332, In-Fill Development Projects, states that a Class 32 exemption consists of projects <br />characterized as in-fill development meeting the conditions described below. <br /> <br />(a) The project is consistent with the applicable general plan designation and all applicable general plan <br />policies as well as with applicable zoning designation and regulations. <br /> <br />(b) The proposed development occurs within city limits on a project site of no more than five acres <br />substantially surrounded by urban uses. <br /> <br />(c) The project site has no value as habitat for endangered, rare or threatened species. <br /> <br />(d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or <br />water quality. <br /> <br />(e) The site can be adequately served by all required utilities and public services. <br />
