Tustin <br />Avenue) <br />RECOMMENDED ACTION <br />Adopt a resolution approving Conditional Use Permit No. 2025-11 for drive-through <br />window service, as conditioned. <br />EXECUTIVE SUMMARY <br />John Caglia, representing Dutch Bros Inc., (Applicant), on behalf of Hall John C Trust <br />(Property Owner), is requesting approval of Conditional Use Permit (CUP) No. 2025-11, <br />to allow the construction of a new eating establishment, Dutch Bros, with drive-through <br />window services at 1819 N. Tustin Avenue. Pursuant to Section 41-365.5(e) of the Santa <br />Ana Municipal Code (SAMC), eating establishments with drive-through window service <br />require approval of a CUP. Staff recommends approval of the request as the proposed <br />project will revitalize a vacant site along a major commercial corridor, reintroducing <br />business activity to the area. Moreover, the project aligns with General Plan goals and <br />policies by preserving and enhancing the character and integrity of existing <br />neighborhoods and districts, promoting a clean, safe environment while fostering <br />economic growth and fiscal stability for the City. The project’s design carefully addresses <br />potential impacts related to noise, traffic, lighting, and odor, ensuring it will not adversely <br />affect the surrounding community. <br />DISCUSSION <br />Project Description <br />The proposed project includes construction of a new single-story, 1,025-square-foot <br />commercial pad building with site improvements of approximately 20,629 square feet in <br />size. The development includes rehabilitated and enhanced drought-tolerant landscaping <br />throughout the site, double drive-through lanes spanning approximately 272 feet with a <br />500-foot stacking length, a trash enclosure, and 24 parking stalls, four of which are <br />designed to be EV-ready. To facilitate the project, the applicant proposes merging two <br />parcels, APNs 396-302-031 and 396-312-15. <br />
