14 <br />h. Never use prohibited pesticides <br />Always check the list of Pesticide Products Prohibited from Use in <br />California Schools and Childcare Facilities prior to using a new pesticide <br />product. <br />i. Complete Annual IPM Training <br />Take a DPR-approved training course before applying pesticides and <br />renew annually. <br />O. Technical Assistance (WIC 10397(c)) <br />Technical assistance shall be provided to any contracting agency making a <br />written request to its assigned consultant or administrator within sixty (60) days of <br />receipt of the request. <br />P. Resolution of Contract Administration Disputes (WIC 10391 and 5 CCR <br />18301) <br />1. The procedure specified in this section shall be used to resolve disputes <br />between contractors and the CDSS that may arise regarding the <br />interpretation and application of any term or condition of a contract, including, <br />but not limited to, requests for waivers, app roval of subcontracts or <br />expenditures requiring approval, requests for reimbursement rate <br />adjustments, or reductions in the total amount of contract reimbursement that <br />are not appealable. <br />2. The contractor shall attempt to resolve contract disputes at the lowest staff <br />level within the CDSS. <br />3. If the dispute is not resolved at the lowest staff level, the contractor may <br />appeal the decision by submitting a written description of the issues and the <br />basis for the dispute to the Bureau Chief of the CDSS having jurisdiction over <br />the contractor's service delivery area. The Bureau Chief shall make a <br />determination and shall send a written notification of the decision to the <br />contractor, together with the reasons for the decision, within thirty (30) <br />calendar days of the receipt of the appeal. The contractor may appeal the <br />decision of the Bureau Chief to the Branch Chief of the CCDD by submitting a <br />written description of the issues in dispute, and a copy of the Bureau Chief’s <br />decision. The Branch Chief of the CCDD shall send notification of the <br />decision to the contractor and shall specify the reason(s) for the decision <br />within thirty (30) calendar days of the receipt of the appeal by the Branch <br />Chief. The decision of the Branch Chief of the CCDD shall be the final <br />administrative action afforded the contractor.
