49 <br />c. Use – When equipment is purchased in whole or in part with state funds, <br />the contractor shall use the equipment exclusively in the program(s) from <br />which funds were used to purchase the equipment. If the contractor <br />wishes to share the use of the equipment between/among two (2) or more <br />programs, the cost of such equipment shall be prorated between/among <br />the programs. <br />d. Disposition – The contractor may dispose of obsolete equipment and <br />remove the asset at its recorded value. If the sale of equipment originally <br />purchased with state funds occurs, the proceeds from the sale of the <br />equipment must be returned to the program. If the contractor no longer <br />has a contract with the CDSS, the contractor shall dispose of the <br />equipment in accordance with written directions from the CDSS. <br />VIII. FUNDING ELIGIBILITY, CONTINUED FUNDING, CONTRACT <br />STATUS, TERMINATIONS, AND APPEALS <br />A. Eligibility for Funding (5 CCR 18001) <br />1. A current contractor is eligible to apply for new or additional funds except <br />when one or more of the following conditions apply during the Request for <br />Application (RFA) cycle: <br />a. The contractor is on conditional status because of fiscal or programmatic <br />noncompliance as described in paragraphs D, Administrative Review of <br />Changes in Contract Status; or E, Conditional Contract Status Procedure, <br />below; or <br />b. The CDSS has conducted a compliance review and the contractor has <br />failed to cure items of fiscal and programmatic noncompliance identified in <br />the review within twelve (12) months of the issuance of the compliance <br />review report; or <br />c. The CDSS reduced the contractor’s current year maximum reimbursement <br />amount due to the contractor’s inability to utilize its full contract amount, <br />whether through low enrollment or low expenditures for the same contract <br />type. <br />2. A current contracting agency may be determined, on a case-by-case basis, to <br />be ineligible to receive expansion funding if: <br />a. The agency was previously awarded expansion funding and has not yet <br />begun to provide services with that funding; or <br />b. The CDSS has evidence that the agency has not been able to <br />successfully fulfill current contract requirements by serving children in a <br />quality program and in a fiscally responsible manner.
