50 <br />3. A current contractor that is applying for additional funds may be awarded less <br />than the full amount requested during negotiations of the award, particularly if <br />it has been determined that they are not fully utilizing their current contract <br />maximum reimbursable amount. <br />4. An applicant that is not a current CDSS contractor is not eligible to apply for <br />funding if one of the following conditions apply: <br />a. The contractor had a previous contract with the CDE or CDSS that was <br />terminated or not continued by the CDE or CDSS for fiscal or <br />programmatic noncompliance as described in paragraphs D, <br />Administrative Review of Changes in Contract Status; or E, Conditional <br />Contract Status Procedure, below within three (3) years immediately <br />preceding the date the RFA was posted; or <br />b. The applicant contractor has an outstanding accounts receivable balance <br />with the CDSS; or <br />c. The applicant contractor has a delinquent audit with the CDE or CDSS <br />pursuant to Section V, paragraph C, Delinquent Audits and One-Time- <br />Only Extensions. <br />B. Review of Contracts for Continued Funding (5 CCR 18010) <br />1. Contractors have no vested right to a subsequent contract. <br />2. Contractors that are not on conditional contract status, but which have <br />evidenced fiscal or programmatic noncompliance with the provisions of this <br />contract, laws, or regulations, shall receive an administrative review to <br />determine whether they will receive an offer for continued funding. <br />3. Contractors currently on conditional status that do not meet the requirements <br />specified in the Conditional Status Addendum may not be offered a <br />subsequent contract and shall be so notified by the CDSS at least ninety (90) <br />calendar days prior to the end of the current contract period. <br />4. Contractors that intend to accept the offer to continue services in the <br />subsequent contract period shall respond to a continued funding application <br />request from the CDSS in accordance with the instructions and timelines <br />specified in the request. <br />5. Failure to respond within the timelines specified in the continued funding <br />application request shall constitute notification to the CDSS of the contractor's <br />intent to discontinue services at the end of the current contract period unless <br />the contractor has received a written extension of the original timeline from <br />the CDSS.
