55 <br />d. Upon receipt of a notice of intent to terminate, the CDSS will transfer the <br />program to another agency as soon as practicable. <br />2. Immediate Termination (WIC 10398, 10399, and 10401) <br />a. A contracting agency that evidences any of the following acts or omissions <br />may have its contract immediately terminated if there is documented <br />evidence of the acts and omissions, and upon review and <br />recommendation of the general counsel of the CDSS for any of the <br />following reasons: <br />i. Fraud, or conspiracy to defraud. <br />ii. Misuse or misappropriation of state or federal funds, including a <br />violation of WIC 10399. <br />iii. Embezzlement. <br />iv. Threats of bodily or other harm to a state official. <br />v. Bribery or attempted bribery of a state official. <br />vi. Unsafe or unhealthy physical environment or facility. <br />vii. Substantiated abuse or molestation of children. <br />viii. Failure to report suspected child abuse or molestation . <br />ix. Theft of supplies, equipment, or food. <br />x. Cessation of operations without the permission of the CDSS or acts or <br />omissions evidencing abandonment of the contract or contracts. <br />xi. C2AP, C3AP, CAPP, CMAP, and CFCC contractors that fail to fully <br />reimburse a significant number of approved childcare providers as <br />determined by the CDSS, within fifteen (15) calendar days after the <br />date set in the plan for timely payments to childcare providers, adopted <br />by the contracting agency, pursuant to 5 CCR 18226, unless the failure <br />is attributable to a delay in receiving apportionments from the state. <br />xii. Failure to pay salaries owed to employees, or pay federal payroll tax, <br />for more than fifteen (15) days after the employee salaries, or federal <br />payroll taxes were due, unless the failure is attributable to a delay in <br />receiving apportionments from the state.
