59 <br />discretion, may vacate the decision and grant a hearing on a showing of good <br />cause. <br />3. Hearing <br />If the contractor submits a timely request for a hearing, the CDSS shall have <br />ten (10) calendar days to request that the OAH schedule a hearing and <br />transmit the following to the OAH: <br />a. The notice of defense/appeal petition submitted to the CDSS by the <br />contractor; <br />b. The original notice of action sent to the contractor; and <br />c. The name, address, and telephone number of the CDSS authorized <br />representative for the proceeding. <br />d. The OAH shall schedule a hearing on the appeal filed by a contractor to <br />commence no later than thirty (30) calendar days following the receipt of <br />the petition by the CDSS, but at least ten (10) calendar days' written notice <br />will be given of the time and place of the hearing. An OAH hearing officer <br />will hear evidence submitted by the CDSS and the contractor during the <br />hearing. The hearing will be recorded. The hearing officer may continue <br />hearings, if deemed necessary. <br />4. The Decision <br />The hearing officer shall issue a final decision, in writing, within thirty (30) <br />calendar days after the submission of the case. The decision shall be sent by <br />registered mail or personally served on the representatives of the parties by <br />OAH. The decision shall be the final administrative action afforded the <br />contractor. <br />5. Settlement between the Parties <br />The CDSS and contractor may, at any time before or after issuance of a <br />notice of action, agree to a settlement of the actions. The settlement terms, <br />as agreed to by both parties, are to be incorpo rated into a stipulation and <br />waiver decision that is approved by the CDSS agency head or his or her <br />designee and issued by the CDSS. The decision shall be the final <br />administrative action afforded the contractor. <br />6. Request for Additional Written Materials on File at CDSS <br />Contractors may request, in writing, any public documents on which the <br />CDSS intends to rely from the CDSS files at a cost of fifteen cents ($.15) <br />cents per page, payable in advance. The CDSS will mail the material <br />requested not later than ten (10) days from the receipt of the request.
