68 <br />b. Children 3 to 21 years of age, inclusive, who have been determined to be <br />eligible for special education and related services by an individualized <br />education program team according to the special education requirements <br />contained in Part 30 (commencing with Section 56000) of Division 4 of <br />Title 2, and who meet eligibility criteria described in Section 56026 and, <br />Article 2.5 (commencing with Section 56333) of Chapter 4 of Part 30 of <br />Division 4 of Title 2, and Sections 3030 and 3031 of Title 5 of the <br />California Code of Regulations. These children shall have an active <br />individualized education program and shall be receiving early intervention <br />services or appropriate special education. <br />Children with severe disabilities or Severely disabled children are children <br />with exceptional needs from birth to twenty-one (21) years of age, inclusive, who <br />require intensive instruction and training in program s serving pupils with the <br />following profound disabilities: autism, blindness, deafness, severe orthopedic <br />impairments, serious emotional disturbance, or severe developmental disability. <br />This also includes those individuals who would have been eligible for enrollment <br />in a developmental center for handicapped pupils under Chapter 7 (commencing <br />with Section 56900) of Part 30 of Division 4 of Title 2 of the Education Code. <br />(WIC 10213.5(y)) <br />Co-located Programs are those that share the same facility but cannot be <br />commingled because they are different types of programs with different program <br />requirements. <br />Commingled Childcare Services means the provision of services to both <br />subsidized and nonsubsidized children in the same classroom at the same time . <br />(5 CCR 18013(i)) <br />Compliance review or Contract Monitoring Review means that a team of the <br />CDSS staff reviews a contractor's program at the program site to determine <br />compliance with applicable laws, regulations, or contractual provisions . (5 CCR <br />18023(a)(1)) <br />Contract Period means the time span the contract is in effect as specified in the <br />child development contract. (5 CCR 18013(i)) <br />Co-payment means any usual and customary provider charges that exceed the <br />maximum subsidy amount. The family shall be responsible for paying the <br />provider the difference between the provider's rate and the maximum subsidy <br />amount. This shall be considered the family’s co-payment. The contractor shall <br />not be responsible for collecting the family's co -payment. (5 CCR 18220.6(b)) <br />CSPP Four-year-old children means children who will have their fourth birthday <br />on or before December 1 of the fiscal year in which they are enrolled in a <br />California state preschool program, or a child whose fifth birthday occurs after <br />September 1 of the fiscal year in which they are enrolled in a California state
