✓ AGREEMENT THE CITY OF SANTA ANA, a Municipal Corporation and THE CITY OF FOUNTAIN VALLEY, a Municipal Corporation, both situated in the County of Orange, State of California, do hereby enter into the following agreement: WITNESSETH WHEREAS, City of Santa Ana and City of Fountain Valley contem- plate the installation of a traffic control signal system and highway light- ing to provide for the orderly movement of traffic at the intersection of Edinger Avenue with Newhope Street, within the City of Santa Ana and the City of Fountain Valley. WHEREAS, the City boundary line lies within the right of way of Edinger Avenue; and WHEREAS, City of Santa Ana has the north leg (Newhope Street) and a large portion of Edinger Avenue entering the intersection within the City limits of Santa Ana; and WHEREAS, City of Fountain Valley has the south leg (Newhope Street) and a small portion of Edinger Avenue entering the intersection within the City limits of Fountain Valley; and WHEREAS, both cities desire to specify the proportionate share of the construction and maintenance costs to be paid by each City; and WHEREAS, both cities desire to specify the city responsible for the construction and maintenance of said traffic control signal system and highway lighting; NOW, THEREFORE, IT IS AGREED AS FOLLOWS: SECTION I For and in consideration of the covenants and conditions to be kept and performed by the City of Fountain Valley, the City of Santa Ana agrees : a. To furnish traffic control signal system and highway light- ing hereinabove mentioned, through construction by contract with contractors licensed by the State of California, said contract to be carried out in ac- cordance with the provisions of the Government Code, and to be completed in conformity with plans and specifications as approved by City of Santa Ana and City of Fountain Valley.
