RR SS-1: New residential and commercial development shall pay development fee <br /> authorized by Section 65996 of the California Government Code to be "full and complete <br /> school facilities mitigation." <br /> Explanation of the Rationale: The Project would have the potential to generate approximately <br /> 307 new elementary school students, 176 new intermediate school students, and 226 new high <br /> school students, for a total of 709 new students. All three Santa Ana Unified School District <br /> schools serving the project site have enrollment capacity to serve the Project at buildout. In <br /> addition, the Project would be required to pay developerlimpact fees pursuant to Senate Bill 50, <br /> which would further reduce potential impacts to school services. Pursuant to California <br /> Government Code Section 65995, payment of development fees would provide full and complete <br /> mitigation of school impacts. (Draft Supplemental EIR, pp. 4.11-17—4.11-18.) <br /> Threshold LS-1: The Project would not result in substantial adverse physical impacts <br /> associated with the provision of new or physically altered library facilities, <br /> the construction of which could cause significant environmental impacts, in <br /> order to maintain acceptable service ratios and response times or other <br /> performance objectives for library services. <br /> Findings: The City finds that the Project would result in less-than-significant impacts to public <br /> services related to library services. (Draft Supplemental EIR, pp. 4.11-18--4.11-20.) <br /> Additionally, the City finds that the Project will implement the following regulatory requirement <br /> (Draft Supplemental EIR, p. 4.11-6): <br /> RR LS-1: New residential development shall pay a property excise tax per the City <br /> Municipal Code Section 35-114, Residential Development Tax. <br /> Explanation of the Rationale: The Project would be consistent with the land use designations <br /> proposed in the GPU PEIR; thus, no new substantial unplanned growth would occur that was not <br /> previously analyzed in the GPU PEIR. Nonetheless, the anticipated growth generated by the <br /> Project would increase the demand for library services in the City. However, through compliance <br /> with the policies regarding the payment of residential development tax and property taxes, which <br /> would contribute to the City's general fund that could potentially be used for the expansion of the <br /> existing libraries or construction of new library facilities, the Project's impacts on library services <br /> would be less than significant. (Draft Supplemental EIR, pp. 4.11-18--4.11-20) <br /> Cumulative Impacts: The Project would not result in cumulative impacts concerning <br /> public services. <br /> Findings: The City finds that the Project would result in less than significant cumulative impacts <br /> concerning public services.
