General Order No. 11-10 <br /> 1 ADR or settlement proceeding; <br /> 2 (c) a report to or an inquiry by the ADR Judge pursuant to sections <br /> 3 10 and 11 below, regarding a possible violation of policies and <br /> 4 procedures governing the ADR Program; <br /> 5 (d) the mediator from discussing the mediation process with the <br /> 6 ADR Program. staff, who shall maintain the confidentiality of the <br /> 7 process; <br /> 8 (e) any participant or the mediator from responding to an <br /> 9 appropriate request for information duly made by persons <br /> 10 authorized by the Court to monitor or evaluate the Court's ADR <br /> 11 program; <br /> 12 (f) disclosures as are required by this Order, related ADR forms, <br /> 13 and as otherwise required by law; or <br /> 14 (g) in an action or proceeding to enforce a settlement, the admission <br /> 15 of a written settlement agreement or a settlement placed on the <br /> 16 record, reached as a result of mediation. <br /> 17 9.3 Confidentiality Agreement. The mediator may ask the parties and all <br /> 18 persons attending the mediation to sign a confidentiality agreement on a form <br /> 19 provided by the Court and attached as "Exhibit L." The confidentiality provisions <br /> 20 of this section apply regardless of whether a confidentiality agreement is signed. <br /> 21 9.4 Sc op Nothing in this rule is intended to limit any applicable privilege <br /> 22 or rule of evidence designed to protect mediation confidentiality, and any such <br /> 23 broader protection shall control if applicable. See Civil L.R. 16-15.8. <br /> 24 <br /> 25 10. VIOLATIONS OF THIS ORDER BY COUNSEL OR A PARTY <br /> 26 10.1 Informal Resolution.
