A writ of mandate may be issued by any court to any inferior tribunal, <br /> 2 corporation, board, or person, to compel the performance of an act which the law <br /> 3 specially enjoins, as a duty resulting from an office, trust, or station...." (Code Civ. Proc., <br /> 4 § 1085, subd. (a).) Indeed, "[t]he writ must be issued in all cases where there is not a <br /> 5 plain, speedy, and adequate remedy, in the ordinary course of law ... upon the verified <br /> 6 petition of the party beneficially interested." (Id. , § 1086.) In essence, "[m]andamus lies <br /> 7 to compel the performance of a clear, present, and ministerial duty where the petitioner <br /> 8 has a beneficial right to performance of that duty." (Carrancho v. California Air <br /> 9 Resources Board (2003) 111 Cal.AppAth 1255 1265) "A duty is ministerial when it is <br /> 10 the doing of a thing unqualifiedly required." (Redwood Coast Watersheds Alliance V. <br /> 11 State Bd. of Forestry& Fire Protection (1999) 70 Cal.AppAth 962, 970). <br /> 12 60. Plaintiffs seek a writ of mandate commanding Defendants to investigate <br /> 13 Plaintiff's complaint regarding the release of the confidential information and to inform <br /> 14 Plaintiff of the outcome of that investigation. Plaintiff further seeks an order of the court <br /> 15 mandating that Defendants, and each of them, fully investigate any and all complaints <br /> 16 made to the City of Santa Ana/Santa Ana Police Department regarding the misconduct <br /> 17 of police department employeeslofficials. <br /> 18 61. Plaintiffs have no plain, speedy or adequate remedy under the law. <br /> 19 Plaintiffs have attempted to exhaust all administrative remedies to redress the violation <br /> 20 of their rights. <br /> 21 62. Plaintiffs request this court to award ancillary damages pursuant to C.C.P. <br /> 22 §1090 and 1095. <br /> 23 63. The actions of defendants, and each of them, were arbitrary and <br /> 24 capricious and, therefore, Plaintiffs are entitled to recover attorneys' fees pursuant to <br /> 25 Government Code §800. <br /> 26 64. The success of Plaintiffs in this action will result in the enforcement of an <br /> 27 important right affecting the public interest in that a significant benefit will be conferred <br /> 28 on a large class of persons, that is, public employees, and the necessity and financial <br /> 13 <br /> COMPLAINT <br />
