Such employee may not receive time off with pay as compensation for <br /> overtime accrued as a result of court appearances . <br /> B . A subpoenaed employee scheduled to appear in court on <br /> City business during off-duty time may be placed on stand-by status <br /> by his or her department head or authorized representative . In the <br /> event such off-duty employee is on stand-by status during any court <br /> session and is not required to appear in court, such employees <br /> shall be compensated two (2) hours' overtime, paid on a straight <br /> time basis, for each court session. If such off-duty employee on <br /> stand-by actually appears in court, he or she shall be compensated <br /> only as provided in Subsection A, supra. Any employee on stand-by <br /> status who fails to appear in court ready to testify within (30) <br /> minutes after notification to appear shall not receive compensation <br /> for either stand-by or for appearance . <br /> C. Notwithstanding Subsections A and B, supra, whenever <br /> an employee either commences or terminates his or her on-duty shift <br /> while he or she is appearing in court or is on stand-by status, his <br /> or her sole compensation for off-duty time spent in court or on <br /> stand-by shall be on a straight time basis paid in half-hour <br /> increments . <br /> D. Effective April 15, 1986, the above provisions of this <br /> Section shall apply only to personnel exempted from coverage under <br /> the overtime provisions of the FLSA. <br /> E . Employees assigned to a 3/12 - 4/12 Work Schedule who <br /> appear in court during their regularly scheduled workweek, and as <br /> a result do not receive adequate rest, will be allowed to flex <br /> their scheduled shift start time up to four hours, with the <br /> approval of the employee' s immediate supervisor and watch <br /> commander, or immediate supervisor and section commander. <br /> Alternatively, the employee may be allowed to use up to four hours <br /> from "Time Off Bank" or from compensatory time off at the beginning <br /> of their scheduled shift to ensure adequate rest . <br /> Section 15 . Creation of Compensation Time Bank. <br /> A. Any member of the Association who works overtime, or <br /> has accrued but unused holidays, can designate that he or she will <br /> contribute the value of such time to a bank for use by members of <br /> the Association for the purposes and subject to the restrictions <br /> provided herein. <br /> B . Any member of the Association may receive time off for <br /> the welfare of officers, community service and any lawful activity <br /> of the Association with pay drawn from the bank described in <br /> Subsection A of this Section, provided that said employee first <br /> gain approval for said use by the executive board of the <br /> Association in the manner specified by its rules as adopted from <br /> time to time, and subject to the approval or disapproval of the <br /> 19 <br />
