Such payments are not increases in base salary and no <br /> salary rate range applicable to any of the employees covered by <br /> this Agreement shall be changed or deemed to have been changed by <br /> reason thereof . As a result, the City will not treat these payments <br /> as ordinary income and thus, will not withhold federal or state <br /> income tax from said payments . The City has received an opinion or <br /> ruling from the Internal Revenue Service confirming that these <br /> payments are deferred compensation, not ordinary income . <br /> In the event that the City receives a subsequent ruling <br /> from the Internal Revenue Service that such payments are ordinary <br /> income of the employees instead of deferred compensation, the <br /> City' s obligation to make such payments shall discontinue and in <br /> place thereof the base salary of each affected employee shall <br /> forthwith be increased by eighteen (18) salary rate ranges (9 . 0%) <br /> for "safety-member" and fourteen (14) salary rate ranges (7 . 0%) for <br /> all "miscellaneous-member" employees covered by this Agreement . <br /> For the purpose of reporting an employee' s compensation <br /> to P .E.R. S . , the City shall include these payments as if they were <br /> a part of the employee' s base salary. <br /> C. The City will provide P.E.R. S. third level of 1959 <br /> Survivors Benefit to all eligible employees in the unit . <br /> ARTICLE XIV - RELEASE TIME FOR ASSOCIATION REPRESENTATIVE <br /> During the term of this Agreement, the City agrees to grant full- <br /> time release from duty for one (1) Association representative for <br /> the conduct of Association affairs subject to the following: <br /> Section 1 . The Association shall reimburse the City for one <br /> hundred percent (1000) of salary (including any salary additives, <br /> such as career incentive pay) and benefit costs . Such reimbursement <br /> may be from the bank established pursuant to Section 15 of Article <br /> VIII of this Agreement . <br /> Section 2 . The Association shall provide an insurance policy <br /> or policies, or certificate of such insurance, naming the City of <br /> Santa Ana, its officers, employees and agents as insured or <br /> additional insured, which provides coverage against liability for <br /> any and all claims and/or suits for damages or injuries to persons <br /> or property resulting from or arising out of any act or omission of <br /> said Association representative . Said policy or policies of <br /> insurance shall provide coverage for both bodily injury and <br /> property damage in not less than the following minimum amounts : One <br /> million dollars ($1, 000 , 000 . 00) combined single limit or its <br /> equivalent . Said policy or policies shall also contain a provision <br /> that no termination, cancellation or change of coverage of insured <br /> or additional insured shall be effective until thirty (30) days <br /> notice thereof has been given in writing to the City of Santa Ana. <br /> 37 <br />
