Section 3 . The Association shall provide the City of Santa Ana <br /> with an insurance certificate from a workers' compensation <br /> insurance carrier certifying that it carries primary workers' <br /> compensation insurance on behalf of said Association representative <br /> and the policy shall not be cancelled nor the coverage reduced <br /> except upon ten (10) days' prior notice to the City of Santa Ana. <br /> Section 4 . The Association shall indemnify and save harmless <br /> the City of Santa Ana, its officers and employees, from and against <br /> any and all damage to property or injuries to or death of any <br /> person or persons, including property and employees or agents of <br /> the City of Santa Ana, and shall defend, indemnify and save <br /> harmless the City of Santa Ana, its officers and employees, from <br /> any and all claims, demands, suits, actions or proceedings of any <br /> kind of nature, including, but not by way of limitation, workers' <br /> compensation claims, resulting from or arising out of the negligent <br /> acts, errors, or omissions, or arising out of the intentional or <br /> malicious acts of Association' s representative . <br /> Section 5 . The Association and the City of Santa Ana agree <br /> that Association' s representative will not be required to carry out <br /> any peace officers' duties during such time that Association' s <br /> representative is on such full-time release from duty. The <br /> Association' s representative will be required to comply with the <br /> Rules and Regulations of the Santa Ana Police Department as they <br /> apply to off-duty employees, except such representative will not be <br /> required to report for duty for any purpose . <br /> Section 6 . Upon return to duty from such full-time release, <br /> the Association' s representative shall be restored to the same <br /> position without loss of any benefits as he or she would have <br /> occupied or accrued if there had been no disruption in duty status. <br /> A. The Association agrees that since the Association <br /> Representative does not report for duty or account to the City for <br /> his or her sick leave or vacation time, that vacation and sick <br /> leave accruals shall be treated as follows : <br /> B . The Association Representative shall accrue eight (8) <br /> hours of sick leave each month until the accrued sick leave total <br /> reaches a maximum of 1600 hours . <br /> C. Vacation shall be accrued consistent with existing <br /> POA MOU provisions . The Association Representative may not carry <br /> over from one (1) calendar year to the next more than the <br /> equivalent of one (1) longevity vacation period and the equivalent <br /> of one (1) regular vacation period from the previous two (2) years . <br /> Regular vacation in excess of that accrued during the previous two <br /> (2) year period will be forfeited. <br /> D. POA President may not donate his/her accrued vacation <br /> or holiday time . <br /> 38 <br />
