then set forth the grievance in writing, indicate <br /> the nature of the action desired, sign it , and <br /> submit it in duplicate to his or her immediate <br /> supervisor. At this point, the grievance review <br /> process becomes formal . Should the grievant fail to <br /> file a written grievance, and in the manner <br /> specified above, within ten (10) working days after <br /> discussing the grievance with his or her Section <br /> Commander, the grievance shall be barred and <br /> waived. <br /> 18 . 3 Formal Process . <br /> A. If the grievance is not resolved through the <br /> informal process, and a written grievance is filed <br /> within the time limits set forth above, the <br /> grievant' s immediate supervisor and Section <br /> Commander will add their comments and any <br /> justification they consider proper, sign it, and <br /> forward it to their Division Commander without <br /> undue delay, or in no case, more than three (3) <br /> working days . <br /> B. The Division Commander, after study of the case, <br /> shall attach his or her decision and reasons <br /> therefore, and return them to the employee within <br /> three (3) working days after receipt of the written <br /> grievance . <br /> C. If no satisfactory settlement has been reached at <br /> the division level, the employee may, within six <br /> (6) working days after receipt of the Division <br /> Commander' s decision and reason (s) therefore, carry <br /> the matter to the Police Chief . To do so, the <br /> employee shall describe on separate correspondence, <br /> the reason why he or she is not satisfied, and <br /> shall submit this, with the original form through <br /> his or her superior officer and Division Commander <br /> to the Police Chief . Failure of the grievant to <br /> take this action will constitute a waiver and bar <br /> to the grievance, and the grievance will be <br /> considered settled on the basis of the Division <br /> Commander' s response. <br /> D. If the grievant files a written grievance to the <br /> Police Chief in the manner and within the time <br /> limits specified in "C" above, then a conference <br /> shall be held at the request of the employee or the <br /> Chief of Police . <br /> E . The Police Chief shall inform the employee of his <br /> action within ten (10) working days after the <br /> 57 <br />
