STATEWIDE SANITARY SEWER SYSTEMS GENERAL ORDER <br /> <br />(https://ciwqs.waterboards.ca.gov). If additional assistance is needed to establish an <br />online CIWQS user account, contact State Water Board staff by email at <br />CIWQS@waterboards.ca.gov.The online user account will provide the Enrolleesecure <br />access to the online CIWQS database for electronic reporting. <br />2.3. Regulatory Coverage Transfer <br />Regulatory coverage under this General Order is not transferable to any person or party <br />except after an existing Enrollee submits a written request for a regulatory coverage <br />transfer to the Deputy Director, at least 60 days in advance of any proposed system <br />ownership transfer. The written request must include a written agreement between the <br />existing Enrollee and the new Enrollee containing: <br /> Acknowledgement that the transfer of ownership is solely of an existing system with <br />an existing waste discharge identification (WDID) number; <br /> The specific ownership transfer date in which the responsibility and regulatory <br />coverage transfer between the existing Enrollee and the new Enrollee becomes <br />effective; and <br /> Acknowledgement that the existing Enrollee is liable for violations occurring up to the <br />ownership transfer date and that the new Enrollee is liable for violations occurring on <br />and after the ownership transfer date. <br />The Deputy Director will consider approval of the written request. If approved, the <br />Deputy Director will issue a Notice of Applicability letter which serves as an approved <br />transfer of regulatory coverage to the new Enrollee. <br />3. FINDINGS <br />3.1. Legal Authorities <br />3.1.1.Federal and State Regulatory Authority <br />The objective of the Clean Water Act is to restore and maintain the chemical, physical, <br />and biological integrity of the waters of the United States (33 U.S.C. 1251). The Water <br />Code authorizes the State Water Board to implement the Clean Water Act in the State <br />and to protect the quality of all waters of the State (Water Code sections 13000 and <br />13160). <br />3.1.2.Discharge of Sewage <br />A discharge of untreated or partially treated sewage is a discharge of waste as defined <br />in Water Code section 13050(d) that could affect the quality of waters of the State and is <br />subject to regulation by waste discharge requirements issued pursuant to Water Code <br />section 13263 and Chapter 9, Division 3, Title 23 of the California Code of Regulations. <br />A discharge of sewage may pollute and alter the quality of the waters of the State to a <br />degree that unreasonably affects the beneficial uses of the receiving water body or <br />facilities that serve those beneficial uses (Water Code section 13050(l)(1)). <br /> <br />ORDER 2022-0103-DWQ December 6, 2022 <br />7 <br /> <br />
