STATEWIDE SANITARY SEWER SYSTEMS GENERAL ORDER <br />violation of the Clean Water Act and is grounds for an enforcement action by the State <br />Water Board or the applicable Regional Water Board. Failure to comply with the <br />notification, monitoring, inspection, entry, reporting, and recordkeeping requirements <br />may subject the Enrollee to administrative civil liabilities of up to $10,000 a day per <br />violation pursuant to Water Code section 13385; up to $1,000 a day per violation <br />pursuant to Water Code section 13268; or referral to the Attorney General for judicial <br />civil enforcement. Discharging waste not in compliance with the requirements of this <br />General Order or the Clean Water Act may subject the Enrollee to administrative civil <br />liabilities up to $10,000 a day per violation and additional liability up to $10 per gallon of <br />discharge not cleaned up after the first 1,000 gallons of discharge; up to $5,000 a day <br />per violation pursuant to Water Code section 13350 or up to $20 per gallon of waste <br />discharged; or referral to the Attorney General for judicial civil enforcement. <br />6.1.2. Monetary Penalties <br />The Water Code provides the State and Regional Water Boards the authority to pursue <br />formal enforcement actions, including imposing administrative liability and civil monetary <br />penalties, for non-compliance with the requirements of this General Order and violations <br />of the Clean Water Act. <br />6.1.3. Falsifying or Failure to Report <br />The Water Code provides that any person failing or refusing to furnish technical or <br />monitoring program reports, as required under this General Order, or falsifying any <br />information provided in the technical or monitoring reports is subject to administrative <br />liability and civil monetary penalties. Any person who knowingly fails or refuses to <br />furnish technical or monitoring program reports or falsifies any information provided in <br />reports required by this General Order is subject to criminal penalties. <br />6.1.4. Severability of General Order <br />The provisions of this General Order are severable; if any provision of this Order, or the <br />application of any provision of this Order to any circumstance, is held invalid, the <br />application of such provision to other circumstances and the remainder of this Order <br />shall not be affected thereby. <br />6.1.5. Indirect Discharges <br />In the event that a spill enters into a drainage conveyance system, the Enrollee shall <br />take all feasible steps to prevent discharge of sewage into waters of the State by <br />blocking or redirecting the flow in the drainage conveyance system, removing the <br />sewage from the drainage conveyance system, and cleaning the system in a manner <br />that does not inadvertently impact beneficial uses of the receiving water body. <br />6.1.6. Water Boards' Considerations for Discretionary Enforcement <br />Consistent with the State Water Board Enforcement Policy, when considering Water <br />Code section 13327 factors, the State Water Board or a Regional Water Board may <br />consider the Enrollee's efforts to contain, control, clean up, and mitigate spills.
