STATEWIDE SANITARY SEWER SYSTEMS GENERAL ORDER <br />5.16. Voluntary Notification of Spills from Privately -Owned Laterals and/or Systems to <br />the California Office of Emergency Services <br />Upon observing or acquiring knowledge of any of the following from a private sewer <br />lateral or private sanitary sewer system that is not owned/operated by the Enrollee, the <br />Enrollee is encouraged to notify the California Office of Emergency Services (as <br />provided by Health and Safety Code section 5410 et. seq. and Water Code section <br />13271), or inform the responsible party that State law requires such notification to the <br />Office of Emergency Services by any person that causes or allows a sewage discharge <br />to waters of the State: <br />• A spill equal to 1,000 gallons or more that discharges (or has a potential to <br />discharge) to waters of the State, or a drainage conveyance system that discharges <br />to waters of the State; or <br />• A spill of any volume to surface waters. <br />5.17. Unintended Failure to Report <br />If an Enrollee becomes aware that they unintentionally failed to submit relevant facts in <br />any report required in this General Order, the Enrollee shall promptly notify Regional <br />Water Board and State Water Board staff. Regional Water Board contact information is <br />included in Attachment F of this Order. State Water Board staff shall be contacted by <br />email at San itar Sewer waterboards.ca.gov for assistance in formally amending the <br />corresponding report(s) in the online CIWQS Sanitary Sewer System Database. <br />5.18. Duty to Report to Water Boards <br />In accordance with Water Code section 13267 and/or section 13383, upon request by <br />the State Water Board Executive Director (or designee) or a Regional Water Board <br />Executive Officer (or designee), the Enrollee shall provide the requested information <br />which the State or Regional Water Board deems necessary to determine compliance <br />with this General Order. <br />5.19. Operation and Maintenance <br />To prevent discharges to the environment, the Enrollee shall maintain in good working <br />order, and operate as designed, any facility or treatment and control system designed to <br />contain sewage and convey it to a treatment plant. <br />6. PROVISIONS <br />6.1. Enforcement Provisions <br />The following enforcement provisions are based on existing federal and state <br />regulations, laws and policies, including the federal Clean Water Act, the state Water <br />Code and the State Water Board Enforcement Policy. <br />6.1.1. Enforceability of Clean Water Act and Water Code Violations <br />Noncompliance with requirements of this General Order or discharging sewage without <br />enrolling in this General Order constitutes a violation of the Water Code and a potential <br />ORDER 2022-0103-DWQ <br />December 6, 2022 <br />27 <br />
