City may authorize use of such leave for City approved medical appointments <br />whenever such appointments cannot be secured outside the employee's regular <br />workday, and salary continuation or workers' compensation benefits are not <br />available. <br />D. Limit. The maximum total accumulation of sick leave with pay shall be two <br />thousand (2,000) hours. Sick leave usage of less than a full day shall be charged in <br />minimum increments of one (1) hour, with fractional usage rounded upward to the <br />next higher multiple of one (1). <br />For employees who are hired on or after November 15, 2022, from outside the City <br />into classifications represented by the Association: <br />1. The maximum accumulation of sick leave with pay shall be three hundred fifty- <br />two (352) hours; and <br />2. Any annual accrual over the three hundred fifty-two (352) sick leave hours (up to <br />ninety-six (96) hours) will be converted into an employee's Retirement Health <br />Savings ("RHS") Plan account during the first full pay period in January of each <br />year. <br />E. Extended. The City Manager may grant leave up to six (6) months without pay to an <br />employee who has exhausted all of their accrued sick leave if a licensed physician <br />indicates that the employee will be sufficiently recovered to return to his employment <br />within a six (6) month period. Prior to the expiration of the additional time, the <br />employee may return to his position provided that the employee has a certificate from <br />a licensed physician stating that the employee is able to perform the essential <br />functions of their classification with or without reasonable accommodation. In <br />addition to the above, the City Manager may grant a further extension not to exceed a <br />total of one (1) year without pay. <br />F. Extension by Use of Vacation. After an employee's sick leave has been exhausted, <br />they may be granted permission to take any earned vacation they may have accrued. <br />G. Notice. The employee taking sick leave shall notify their immediate supervisor as <br />established by the Police Department regulations. Sick leave shall only be used for <br />the purposes outlined under California Labor Code § 246.5, Article 11.1 (J), or as <br />otherwise permitted by law. If an employee uses sick leave for a purpose not <br />permitted by this MOU or the law, it will be considered abuse of sick leave. If abuse <br />of sick leave is suspected, a physician's certificate or other satisfactory written <br />evidence may be requested. <br />H. Denial. No employee shall be entitled to sick leave with pay while absent from duty <br />30 <br />
