1, 2013. The parties agree that if there is any other clean up or other retirement legislation <br />which goes into effect during this MOU and if there are provisions of that legislation which, <br />by law, automatically goes into effect, either party may request to negotiate over the <br />legislation, including over the impact. <br />Final compensation for New Safety Members will be based on the highest annual average <br />compensation earnable during a period of at least thirty-six (36) consecutive months <br />preceding the effective date of his or her retirement per Government Code Section 7522.32. <br />Effective July 1, 2013, employees covered under the 2.7% @ 57 retirement formula for <br />Safety shall pay one half of the normal cost rate, as established by CAPERS. <br />14.7 Military Service Credit as Public Service. "Safety" employees and "miscellaneous" <br />employees may elect to purchase up to four (4) years of service credit for any continuous <br />active military or merchant marine service prior to employment. The employee must <br />contribute an amount equal to the contribution for current and prior service that the employee <br />and the employer would have made with respect to that period of service per Government <br />Code Section 21024. <br />14.8 Credit for Unused Sick Leave. All sworn and non -sworn employees can have unused <br />accumulated sick leave at the time of retirement converted to additional service credit at the <br />rate of four thousandths (0.004) years of service credit for each day, eight (8) hours per day, <br />of unused sick leave (i.e., two hundred (200) days of sick leave equals eight tenths (.8) <br />additional years of service credit), pursuant to regulations prescribed by Ca1PERS. The <br />maximum total unused sick leave that can be converted shall be two -hundred fifty days (250) <br />eight (8) hours working days equal to two thousand (2000) hours. Any accumulated sick <br />leave in excess of two thousand (2000) hours shall be forfeited. The City must report only <br />those hours of unused sick leave that were accrued by the employee during the normal course <br />of employment. This section applies to members whose effective date of retirement is within <br />four (4) months or one hundred twenty (120) days of separation from employment. <br />(Government Code Section 20965) <br />The maximum total unused sick leave that can be converted shall be ten (10) eight (8) hour <br />working days equal to eighty (80) hours. Employees hired on or after a contract amendment <br />between the City and Ca1PERS shall not be eligible to convert unused sick leave to Ca1PERS <br />for service credit. <br />
