SANTA ANA REZONE PROJECT <br />INITIAL STUDY/MITIGATED NEGATIVE DECLARATION <br />Environmental Issues <br />e) Conflict with or obstruct implementation of <br />a water quality control plan or sustainable <br />groundwater management plan? <br />Environmental Evaluation <br />Setting <br />Less than <br />Significant <br />Potentially <br />Impact with <br />Significant <br />Mitigation <br />Impact <br />Incorporated <br />❑ <br />❑ <br />Less than <br />Significant <br />Impact No Impact <br />® ❑ <br />Project -related impacts related to water quality can generally occur over several different periods: <br />• During the earthwork and construction phase, when the potential for erosion, siltation, and <br />sedimentation would be the greatest; <br />• Following construction, before the establishment of ground cover, when the erosion potential <br />may remain relatively high; and <br />• After project completion, when impacts related to sedimentation would decrease markedly but <br />those associated with urban runoff would remain similar to existing conditions. <br />National Pollutant Discharge Elimination System <br />Under Section 402 of the Clean Water Act (CWA), the United States Environmental Protection <br />Agency (EPA) has established regulations under the National Pollutant Discharge Elimination System <br />(NPDES) program to control direct stormwater discharges from construction activities disturbing one <br />acre or more of land. In California, the State Water Resources Control Board (State Water Board) <br />administers the NPDES permitting program and is responsible for developing NPDES permitting <br />requirements. The NPDES program regulates industrial pollutant discharges, which include <br />construction activities. The State Water Board works in coordination with the Regional Water Quality <br />Control Boards (RWQCBs) to preserve, protect, enhance, and restore water quality. The City is within <br />the jurisdiction of the Santa Ana RWQCB. <br />Short-term Construction <br />Dischargers whose projects disturb 1 or more acres of soil (or whose projects disturb less than 1 acre <br />but are part of a larger common plan of development that in total disturbs 1 or more acres), are <br />required to obtain coverage under the General Permit for Discharges of Storm Water Associated with <br />Construction Activity Construction General Permit Order 2009-0009-DWQ. Construction activity <br />subject to this permit includes clearing, grading, and disturbances to the ground, such as stockpiling <br />or excavation, but it does not include regular maintenance activities performed to restore the original <br />line, grade, or capacity of the facility.
