EXHIBIT 2
The following railroads currently operate over some or all of the crossings within the proposed quiet zone:
• Southern California Regional Rail Authority (SCRRA)
• National Railroad Passenger Corporation (Amtrak)
• BNSF Railway (BNSF)
• Union Pacific Railway (UP)
SECTION 2—REGULATORY PROVISION FOR ESTABLISHMENT
The quiet zone is proposed to be established based upon the regulatory provision described under 49 CFR
§222.39(b). The implementation of Supplemental Safety Measures (SSMs) and Alternative Safety Measures
(ASMs) at selected crossings reduces the Quiet Zone Risk Index to a level below the Risk Index with Horns.
The Federal Railroad Administration (FRA) notification of approval letter is attached herein as Exhibit A.
In the Application to the FRA for approval of the ASM treatment at Fourth Street, an effectiveness rate of 0.79
was assumed based on the railroad crossing improvements implemented. Previously, the commercial building
on the south side of Fourth Street (east of the railroad tracks) in the southeastern quadrant of the railroad
crossing had a private driveway. This access was secured by a locked gate as shown in the image taken from
internet mapping (see Figure 1). Based on the previous driveway location, the FRA determined the
effectiveness rate in Exhibit A to be a lower at 0.667. However, the image in Figure 1 is outdated because
there is no longer a private driveway at that location. The property owner removed the private driveway and
gate at this location and replaced both with fencing, sidewalk and curb as shown in the Figures 2 and 3.
Regardless of the existence of the driveway on the south side of Fourth Street, the at-grade railroad crossings
qualify for a quiet zone:
• either by the originally proposed effectiveness rate, or
• FRA's lower effectiveness rate value.
The more conservative FRA effectiveness rate still qualifies this location for a quiet zone and this is acceptable
to the City. As part of this NOE letter, the City is providing information regarding the driveway's status simply
as an update and is moving forward based on the FRA's effectiveness rate value provided.
SANTA ANA CITY COUNCIL
Miguel A.Pulido i Sal Tinajero i Vincent F.Sarmiento i Michele Martinez i Angelica Amezcua i P.David Benavides i Roman Rayne
Mayor i Mayor Pro Tem,Ward 6 i Ward 1 i Ward 2 i Ward 3 i Ward 4 i Ward 5
MPulidolsanta-ana.org i STinaiero(asanta-ana.org i VSarmiento(cilsanta-ana.org i MMartinez(a)santa-ana.org i A rnezcua(cc santa-ana.org i DBenavidesnsanta-ana.org i RRevnaC5santa-ana.org
