EXHIBIT 2 <br /> The following railroads currently operate over some or all of the crossings within the proposed quiet zone: <br /> • Southern California Regional Rail Authority (SCRRA) <br /> • National Railroad Passenger Corporation (Amtrak) <br /> • BNSF Railway (BNSF) <br /> • Union Pacific Railway (UP) <br /> SECTION 2—REGULATORY PROVISION FOR ESTABLISHMENT <br /> The quiet zone is proposed to be established based upon the regulatory provision described under 49 CFR <br /> §222.39(b). The implementation of Supplemental Safety Measures (SSMs) and Alternative Safety Measures <br /> (ASMs) at selected crossings reduces the Quiet Zone Risk Index to a level below the Risk Index with Horns. <br /> The Federal Railroad Administration (FRA) notification of approval letter is attached herein as Exhibit A. <br /> In the Application to the FRA for approval of the ASM treatment at Fourth Street, an effectiveness rate of 0.79 <br /> was assumed based on the railroad crossing improvements implemented. Previously, the commercial building <br /> on the south side of Fourth Street (east of the railroad tracks) in the southeastern quadrant of the railroad <br /> crossing had a private driveway. This access was secured by a locked gate as shown in the image taken from <br /> internet mapping (see Figure 1). Based on the previous driveway location, the FRA determined the <br /> effectiveness rate in Exhibit A to be a lower at 0.667. However, the image in Figure 1 is outdated because <br /> there is no longer a private driveway at that location. The property owner removed the private driveway and <br /> gate at this location and replaced both with fencing, sidewalk and curb as shown in the Figures 2 and 3. <br /> Regardless of the existence of the driveway on the south side of Fourth Street, the at-grade railroad crossings <br /> qualify for a quiet zone: <br /> • either by the originally proposed effectiveness rate, or <br /> • FRA's lower effectiveness rate value. <br /> The more conservative FRA effectiveness rate still qualifies this location for a quiet zone and this is acceptable <br /> to the City.
