They pointed their guns and lights at who was wearing a light gray <br />sweatshirt, but one officer said to the other “that’s not him, he’s (LEON) wearing a t-shirt”. The <br />officers briefly focused on who was standing in the southwest corner of the backyard <br />and was wearing a red “hoodie” sweatshirt, but they disregarded him too. did not <br />know name, but said that he lives in the same apartment as <br /> did not know why, but one officer left the backyard, while the other officer <br />stayed and continued looking for LEON. walked up the stairs to their <br />apartment. When they were approximately ¾ of the way up the stairs, looked back <br />towards the backyard and heard the officer tell LEON “get out with your hands up” saw <br />that LEON was in the alcove next door. <br />During the interview, pointed to an alcove area that was located at the south <br />end of the garage structure for 1221 through 1227 North Lacy Street. Between the south end <br />of the garage and a cinder block wall that bordered the parking lot of French Park Care Center, <br />there was a space approximately four to five feet wide that ran the width of the garage. <br />At the east end of the alcove was an approximately five to six foot wooden fence that <br />separated the properties of 1221 through 1227 North Lacy Street and 506 East Washington <br />Avenue. The block wall was approximately six feet tall and three inches wide. <br /> said the officer in the backyard was standing under a large tree next to the south <br />wall. The officer’s left foot was on a makeshift bench that was nailed to the base of the tree <br />and his right foot was on the ground.
