EXHIBIT 2 <br /> 8.2.1 If a dispute arising under this Article involves the Southwest Mountain States <br /> Regional Council of Carpenters or any of its subordinate bodies, an Arbitrator shall be chosen by <br /> the procedures specified in Article V, Section 5, of the Plan from a list composed of John Kagel, <br /> Robert Hirsch, and Thomas Pagan, and the Arbitrator's hearing on the dispute shall be held at the <br /> offices of the Trades Council within fourteen(14) days of the selection of the Arbitrator.All other <br /> procedures shall be as specified in the Plan. <br /> i <br /> i <br /> Section. 8.3 No Work Disruption Over Jurisdiction .All jurisdictional disputes shall be resolved <br /> without the occurrence of any strike, work stoppage, or slow-down of any nature, and the <br /> Employer's assignment shall be adhered to until the dispute is resolved. Individuals violating this <br /> section shall be subject to immediate discharge. <br /> Section 8.4 Pre-Job Conferences As provided in Article 16, each Contractor will conduct a <br /> pre job conference with the appropriate affected. Union(s) prior to commencing work; provided <br /> however, at no time shall the City be responsible for additional costs related to, associated with, or <br /> resulting from Union(s)jurisdictional disputes. The Trades Council and the CWA Administrator i <br /> shall be advised in advance of all such conferences and may participate if they wish. <br /> picketing,onal Disputes If actual or threatened strike sympathy I <br /> strike, work stoppage, slow down .... ...........___ , <br /> Section 8.5 Resolution ofJuirisdicti n <br /> , hand-billing or otherwise advising the public that a I <br /> labor dispute exists, or interference with the progress of Project Work by reason of a jurisdictional <br /> dispute or disputes occurs,the Parties shall exhaust the expedited procedures set forth in the Plan, <br /> if such procedures are in the plan then currently in effect, or otherwise as in Article 7 above. <br /> ARTICLE 9 <br /> MANAGEMENT RIGHTS <br /> F <br /> Section 9.1 Contractor and City Rights The Contractors and the City have the sole and <br /> exclusive right and authority to oversee and manage construction operations on Project Work <br /> without any limitations unless expressly limited or required by a specific provision of this <br /> Agreement or an MLA. In addition to the following and other rights of the Contractors enumerated <br /> in this Agreement, the Contractors expressly reserve their management rights and all the rights <br /> conferred upon them by law. `I`he Contractor's rights include, but are not limited to,the right to: <br /> (a) Plan, direct and control operations of all work; <br /> (b) Hire, promote, transfer and layoff their own employees, respectively, as deemed <br /> appropriate to satisfy work and/or skill requirements; <br /> 1 <br /> (c) Promulgate and require all employees to observe reasonable job rules and security <br /> and safety regulations; <br /> (d) Discharge, suspend or discipline their own employees for just cause; <br /> (e) Utilize, in accordance with City approval, any work methods, procedures or j <br /> techniques, and select, use and install any types or binds of materials, apparatus or equipment, <br /> i <br /> 1 <br /> Community Workforce Agreement 21 City of Santa Ana <br />
