Um, alright, so you have your, your handgun pointed at the subject and <br />you’re telling him to get down to the ground. He’s got his arms extended <br />straight over his head, and eventually after a couple or three times of telling him <br />to go down he gets down on his knees, is that correct? <br />GRAHAM: Ah, yeah, well he gets down in a prone position. <br />CARVO: Oh he gets…okay so he was all the way prone on his stomach. <br />GRAHAM: Yes. <br />CARVO: And, then what are you telling him anything else giving him any other <br />commands? <br />GRAHAM: Ah because he still was looking back and forth with his head. His head was still <br />up. <br />CARVO: Okay. <br />GRAHAM: Um, and I told him to put his face to the ground… <br />CARVO: Okay. <br />GRAHAM: … several times and he never did. <br />CARVO: Alright, and then what happened next after that? <br />GRAHAM: Ah, then he attempted to kinda get up in a semi…get up from the prone <br />position, kinda stand up… <br />CARVO: Okay. <br />GRAHAM: …um, and that’s when I jumped the fence. <br />CARVO: Okay. So he started to stand up before you started to jump the fence? <br />GRAHAM: I believe so yes.
