The subject was approximately 5’-11” <br />tall and was wearing a grey sweatshirt, checkered shorts and long white socks. GUILLEN <br />identified the subject as a possible gang member from “Townsend.” As the subject ran past <br />GUILLEN and , GUILLEN heard three or four gunshots. GUILLEN felt burning in his <br />left leg and fell to the ground. GUILLEN immediately knew he had been shot. GUILLEN began <br />to yell for assistance and hid behind a parked vehicle that was nearby. GUILLEN did not know <br />what happened to but believed she left the area after the shooting, possibly to <br />return to her residence. <br />While waiting for assistance, GUILLEN was approached by a SAPD officer who held him <br />at gunpoint. GUILLEN did not recall being given commands by the police officer. GUILLEN <br />assumed he was being held at gunpoint because the police officer thought he was in possession <br />of a firearm. GUILLEN was immediately handcuffed. GUILLEN advised that his contact with the <br />police happened after he was shot. GUILLEN did not recall seeing any police officers at the <br />scene, until after he had been shot. <br />GUILLEN believes he was mistakenly shot during a gang related shooting and does not <br />know the identity of the person responsible for shooting him in the thigh. GUILLEN believes the <br />subject who ran past him in the high school may have been responsible for the shooting; <br />however, GUILLEN did not see the subject in possession of a firearm nor did he recognize him <br />as someone he knew.
