saw Officer Rodriguez approach Freddie from behind and attempt to control both of Freddie’s arms, in an effort to <br />place him under arrest. At that time, I saw Freddie clinch both of his hands and began bringing them towards his waist <br />band in an active effort to resist arrest. In an attempt to help Officer Rodriguez, I tried to grab Freddie’s right arm. At <br />that time, using his right arm, Freddie threw a back hand punch which struck me in the lower torso region. In an effort <br />to gain compliance and overcome Freddie’s resistance, using my right elbow, I delivered an elbow strike towards <br />Freddie’s head, striking him in the head. After assessing my strike, I saw it had no effectiveness and Freddie <br />continued to actively resist arrest and began to stand up, causing all officers to lose leverage and began falling <br />towards the bed. <br />At this point, I could continuously feel Freddie clinching his muscles and attempting to bring his hands towards his <br />unsearched waistline. Officers continued trying to control Freddie’s arms, but were met with continued resistance, <br />causing all parties to begin falling onto the bed. At one point, I saw Officer Mondragon fall back onto the bed and was <br />pinned down due to Freddie falling on top of him. Due to the fact that Freddie had not been searched for weapons, my <br />knowledge of knowing suspects commonly carry weapons in their waistbands, and Officer Mondragon’s duty weapon <br />being easily accessible to Freddie who was lying on top of him, I delivered a right elbow to the back of Freddie’s <br />head, in an effort to gain compliance. At that time, I assessed to see if my strike was effective, to which it was not. Due <br />to the ineffectiveness of my strike, I proceeded to deliver one last right elbow to the back Freddie’s head. I believed I <br />slightly struck Freddie in the upper portion of his back head. Shortly after, I could see officers gain leverage and begin <br />to control Freddie’s movements. Due to the constrictive and small area and the amount of officers on scene, I pulled <br />back from my position to allow officers to take Freddie to the floor. <br />While on the floor, officers were able to place Freddie’s hands behind his back. At that time, I gave Officer Rodriguez <br />my handcuffs to place on both of Freddie’s wrist. <br />Due to Freddie’s continued defiance and combativeness, a decision was made to place him into an agency approved <br />restraining device to keep him from harming himself or officers on scene.
