At this point, Freddie advised us he would be calling his lawyer. Even so, Officer Ibarra and I attempted to negotiate <br />and convince Freddie to leave the room willingly. Freddie refused and began lighting up what appeared to be a <br />cannabis cigar due to the pungent aroma of marijuana. <br />For the safety of my partner and me, additional officers were requested to maintain officer safety and scene safety. <br />Officer Corpus arrived on scene and continued attempting to negotiate and de-escalate the situation, reassuring <br />Freddie we were there to help him. Freddie stated he did not feel safe and was asked how we could make him feel <br />safe, to which he responded, "Shut my fucking door and let me talk to my lawyer." <br />After approximately 13 minutes of non-compliance and complete disregard to Officer commands, CPL Biebrich, <br />Officer Hernandez, Rodriguez, Corpus, Ibarra, and I developed a game plan in order to detain Freddie safely. <br />Officer Ibarra and I cleared the room, and Officers Rodriguez, Corpus, and Hernandez went hands-on. Freddie <br />immediately resisted throwing his body backward toward the Officers, dropping all his weight. Freddie still refused to <br />comply, pulling his arms toward the center of his body, preventing officers from putting his hands behind his back and <br />keeping officers from applying handcuffs. Once I observed Officers go hands-on and Freddie resisting arrest, I <br />holstered my duty weapon and assisted with the detainment of Freddie, grabbing his left arm. Freddie immediately <br />lunged towards me, driving me back into the bed mattress and pinning me and my right hand between him and the <br />mattress. I saw Officer Corpus deliver a strike to Freddie, which appeared to be effective because only then was I <br />able to pull my right arm away from under Freddie, allowing me to reposition myself. <br />Freddie continued to fight, yelling and pulling his hands away from his back, ignoring all the Officers' commands. After <br />a short period, Officers put Freddie on the ground and placed him on his stomach. At this time, I released my hold on <br />Freddie's right arm and transitioned to pinning both his legs to the ground with my arms and legs, maintaining both <br />legs between my legs and holding them in position to keep Freddie from kicking me and my partners. <br />Officer Rodriguez grabbed his left arm, and Cpl Biebrich grabbed his right arm. After full detainment, Officer <br />Rodriguez handcuffed Freddie, and I kept control of his legs. Officer Ibarra made multiple attempts to persuade <br />Freddie to walk downstairs; Freddie responded, "You can kiss my ass. That's what you can do." <br />Cpl Biebrich determined the maximum restraint device (WRAP) would be necessary given Freddie's uncompliant <br />state. Once all Officers were ready, the maximum restraint device was applied, where I assisted with applying the <br />lower ankle restraint and tightening the lower torso straps, restraining all of Freddie's lower and upper movement. <br />During this altercation, my department-issued Axon Body-worn camera was knocked off the center of my chest and <br />placed back on when it was safe to do so. <br />Santa Ana PD 2025-01014 Report by Mondragon, Jonathan 3893 4 of 5
