AMENDMENT APPLICATION NO. 98-09 AND CONDITIONAL USE PERMIT NO. 99-08 <br />(Continued by the Planning Commission April 12, 1999 to April 26, 1999 <br />Filed by Mr. Benjamin Mendoza to allow a zone change from Multiple-Family Residential to Single-Family <br />Residential and a parking suffix and a conditional use permit to allow parking on a vacant pazce] of land for <br />Kely's Body Shop located at 2040 South Cypress Avenue. <br />LEGALLY NOTICED: Mazch 28, 1999 <br />PUBLICLY NOTICED: March 26, 1999 <br />RECOMMENDATION: <br />Recommend that the City Council adopt an ordinance approving Amendment Application No. 98-09. <br />2. Recommend that the City Council adopt a resolution approving Conditional Use Permit No. 99-08 as <br />conditioned. <br /> <br />3. Recommend that the City Council receive and file the Categorical Exemption for Environmental <br />Review No. 97-146. <br />Mr. Vince Fregoso, Senior Planner, presented the staff report, recommendation, and informed the <br />Commission of the proposed modifications to the conditions of approval. <br />Commissioner Solorio disclosed that he had previous conversations with the applicant regazding entitlement <br />and code enforcement activities on the project. <br />Mr. John Estaza, Attorney representing the applicant, informed the Commission that the vehicles had been <br />removed from the lot and the removal caused great financial burden to the applicant; the adjacent neighbors <br />supported the project over multi-family units; and he expressed concerns regarding the conditions of <br />approval and requested that the Commission modify the conditions of approval. <br />Motion recommending that the City Council: I) deny Amendment Application No. 98-09; 2) adopt a <br />resolution denying Conditional Use Permit No. 99-08; and 3) receive and file the Categorical Exemption <br />for Environmental Review No. 97-146. <br />MOTION: Mondo <br />Motion failed. <br />SECONDID: None <br />Motion recommending that the City Council: I) adopt an ordinance approving Amendment Application <br />No. 98-09; 2) adopt a resolution approving Conditional Use Permit No. 99-08 with the modifications to <br />' the Planning Division condition of approval number three to allow storage not to exceed 72 hours, and <br />Planning Division condition of approval number eight to indicate both addresses on Main Street; and 3) <br />receive and file the Categorical Exemption for Environmental Review No. 97-146. <br />MOTION: Solorio <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAINED: <br />Planning Commission Minuses <br />SECONDED: Richardson <br />Verino, Nalle, Doughty, Solorio, Cribb, and Richardson <br />Mondo <br />None <br />None <br />3 <br />Apri126, 1999 <br />
