ENCROACHMENT AGREEMENTS - -- <br />THIS AGREEMENT, made and entered into this � ��'�' day <br />of �� /lrl�f,�.� 1971, by and between the CITY OF SANTA ANA, a <br />municipal corporation, hereinafter called "City" and SADDLEBACK <br />INN SANTA ANA INC_, a corporation, hereinafter called "Corporation", <br />WITNESSETH: <br />WHE REA S , SADD LE BA CK -INN SANTA ANA -INC- <br />ha s made! app 1 i c at i on <br />for an encroachment permit to construct, operate and maintain a <br />pedestrian overpass on First Street between Lyon Street and Mabury <br />Street, in order to connect the SADDLEBACK INN and the adjacent <br />SADD LE BA CK INN proper-ties; <br />WHEREAS, the installation of this overpass would benefit the <br />City by facilitating pedestrian movement anticipated to cross First <br />Street and thereby relieve traffic congestion; NOW THEREFORE, <br />IT IS HEREBY AGREED, by and between the parties hereto, as <br />follows: <br />1_ Corporation is granted permission to construct, operate <br />and maintain a pedestrian overpass spanning in a north /south direction <br />across First Street between Lyon and Mabury Streets connecting the <br />permanent SADD LE BACK INN <br />p rope rt i e s _ <br />2_ Said permission is granted under, the provisions of Santa <br />Ana Municipal Code and subject to all of the terms and conditions <br />contained in said Code_ The permission hereinafter granted is <br />subject to revocation by the City without liability of any kind <br />when and if the City Council shall determine that the public interest, <br />health, safety, and welfare require such revocation_ Ninety (90) <br />days notice shall be given if said revocation become necessary_ <br />3_ Plans and renderings for said overpass shall be subject to <br />the approval of the City Council_ The plans and specifications <br />for said pedestrian overpass shall be subject to the approval of <br />the Director of Public Works of the City of Santa Ana with respect <br />to the design and safety thereof_ <br />4. The plans and specifications for said pedestian overpass <br />shall be subject to the approval of the Building Safety and Housing <br />- 1 - <br />
