ENCROACHMENT AGREEMENTS - -- THIS AGREEMENT, made and entered into this � ��'�' day of �� /lrl�f,�.� 1971, by and between the CITY OF SANTA ANA, a municipal corporation, hereinafter called "City" and SADDLEBACK INN SANTA ANA INC_, a corporation, hereinafter called "Corporation", WITNESSETH: WHE REA S , SADD LE BA CK -INN SANTA ANA -INC- ha s made! app 1 i c at i on for an encroachment permit to construct, operate and maintain a pedestrian overpass on First Street between Lyon Street and Mabury Street, in order to connect the SADDLEBACK INN and the adjacent SADD LE BA CK INN proper-ties; WHEREAS, the installation of this overpass would benefit the City by facilitating pedestrian movement anticipated to cross First Street and thereby relieve traffic congestion; NOW THEREFORE, IT IS HEREBY AGREED, by and between the parties hereto, as follows: 1_ Corporation is granted permission to construct, operate and maintain a pedestrian overpass spanning in a north /south direction across First Street between Lyon and Mabury Streets connecting the permanent SADD LE BACK INN p rope rt i e s _ 2_ Said permission is granted under, the provisions of Santa Ana Municipal Code and subject to all of the terms and conditions contained in said Code_ The permission hereinafter granted is subject to revocation by the City without liability of any kind when and if the City Council shall determine that the public interest, health, safety, and welfare require such revocation_ Ninety (90) days notice shall be given if said revocation become necessary_ 3_ Plans and renderings for said overpass shall be subject to the approval of the City Council_ The plans and specifications for said pedestrian overpass shall be subject to the approval of the Director of Public Works of the City of Santa Ana with respect to the design and safety thereof_ 4. The plans and specifications for said pedestian overpass shall be subject to the approval of the Building Safety and Housing - 1 -
