Department of the City of Santa Ana and subject to issuance of a <br />building permit or permits therefore showing that the plans and <br />specifications comply with the appropriate Building Code requirements <br />of the City of Santa Ana. <br />5. The pedestrian overpass shall be so constructed that a <br />minimum vertical clearance of sixteen (16) feet shall be maintained <br />over the existing roadway at all points_ <br />6_ The supporting columns of the pedestrian overpass shall not <br />be located within any portion of the public right -of -way_ <br />7_ A minimum of four (4) lanes of free - moving traffic, two (2) <br />lanes in each direction, shall be maintained on First Street during <br />construction of said pedestrian overpass_ <br />S_ Any relocation of a facility owned or operated by a public <br />utility company, such as, without limitation, gas mains, power lines, <br />electrical systems, steam pipes, telephone or communication lines <br />necessitated by the construction or location of said structure shall <br />be done at the sole expense of Corporation_ No such relocation, <br />however, shall be done unless arrangements therefore have been made <br />with the affected public utility_ Corporation shall, at its own <br />expense, restore to City standards all curbs, sidewalks, pavements, and <br />other public improvements damaged or altered during construction. A11 <br />work in the City right -of -way shall be accomplished only after obtaining <br />a public works improvement permit for the same_ <br />9. The pedestrian overpass shall be installed and maintained in <br />a safe and sanitary condition, at the sole cost, risk and responsibility <br />of Corporation and successors in interest, who shall hold the City <br />harmless with respect thereto. <br />10. Corporation is responsible for all liability for personal <br />injury or property damage which may arise out of the work herein <br />permitted_ Sn the event any claim of liability is made against the <br />City of Santa Ana, or any department, officer or employee thereof, <br />Corporation shall defend, indemnify and hold them, and each of them, <br />harmless from such claim. <br />11.
