Exhibit 3 <br />■ ■ SAN LORENZO SEWER LIFT STATION <br />.n ENVIRONMENTAL IMPACT REPORT S.O Encur E SUMMARY <br />A complete description of the Project is contained in Section 2.0, Project Description, of this EIR. Please <br />refer to Section 2.0 for additional information, including a detailed description of the construction process <br />and schedule. <br />S.3 EIR PRocEss <br />In December 2008, the City of Santa Ana prepared a CEQA Initial Study and Mitigated Negative <br />Declaration (MND) for the proposed Project. The MND disclosed adverse environmental impacts in the <br />areas of air quality (odor) and short-term construction - related traffic. Mitigation measures were presented in <br />the MND to reduce those impacts to below levels of significance. The MND was circulated for public <br />review, and then approved by the City of Santa Ana on February 2, 2009. Subsequently, the MND was <br />challenged in California Superior Court by an adjacent property owner, Santa Ana California Lodge, LLC. <br />As a result, the Court ordered that the City vacate its approval of the MND, and further required preparation <br />of a project EIR. <br />As a first step in complying with the procedural requirements of CEQA for an EIR, an Initial Study (refer to <br />EIR Appendix A) was prepared by the City of Santa Ana to determine whether any aspect of the proposed <br />Project, either individually or cumulatively, may cause a significant adverse effect on the physical <br />environment. For this Project, the Initial Study indicated that this EIR should focus on five (5) of the six (6) <br />environmental subject areas listed above in Subsection S.1. After completion of the Initial Study, the City <br />filed a NOP with the California Office of Planning and Research (State Clearinghouse) to indicate that an <br />FIR would be prepared. In turn, the Initial Study and NOP were distributed for a 30 -day public review <br />period, which began on April 12, 2010 and ended on May 12, 2010. Written comments on the scope of the <br />EIR were received during those 30 days, and were considered by the City during the preparation of this EIR. <br />After considering public comments on the NOP, the City decided that a sixth subject area (Water Quality and <br />Hydrology), which was not identified in the Initial Study as warranting further analysis, should be added as a <br />subject area to be further analyzed in this EIR. According to CEQA Guidelines Section 15082(c)(1), an <br />advertised public meeting (called a scoping session) was not required because the Project is not of statewide, <br />regional, or area -wide significance as defined by CEQA Guidelines Section 15206. <br />This EIR 4i was being- circulated for review and comment by the public and other interested parties, agencies, <br />and organizations for a 4558 -day review period, which extended from July 14 through September 10, 2010. <br />In response to the public review period for the Draft EIR, the City of Santa Ana received seven (7) comment <br />letters. The City also received a public comment letter just prior to final consideration of the FEIR, which <br />contained new information that the City decided to evaluate further. Based on a review of the comments <br />provided, the City of Santa Ana opted to expand the EIR's analysis of alternative locations for the proposed <br />project and to incorporate other minor revisions into the Draft EIR. The City also decided to recirculate the <br />EIR pursuant to CEQA Guidelines Section 15088.5. During the 45 -day public review period for the RDEIR, <br />public notices announcing availability of the EIR will be mailed to interested parties, <br />advertisements will be posted in the local newspaper, and copies of the HEIR and its Technical <br />Appendices will be available for review at the following locations: City of Santa Ana Public Works Agency, <br />Water Resources Division, 200 S. Daisy Avenue, Santa Ana, CA 92703; and City of Santa Ana Public <br />Works Agency, First Floor, 20 Civic Center Plaza, Santa Ana, CA 92701. <br />After the close of the 45 -day "rniRDEIR public comment period, responses to written comments on the <br />environmental effects of the proposed Project will be prepared and published.
