In providing fire services, OCFA hereby is authorized to and may enforce applicable CITY <br /> codes and ordinances, collect and retain any and all Fire Prevention or Miscellaneous User fees <br /> (excluding paramedic user fees) as determined by OCFA, and file any claims or actions on behalf of CITY <br /> to recover and retain amounts for emergency and hazardous materials responses. <br /> 2. The OCFA Fire Chief hereby is designated as Fire Chief of CITY. <br /> 3. Personnel and equipment routinely assigned to provide services under this Agreement shall <br /> be assigned to Battalion 9. The Battalion Chief of Battalion 9 will exercise day-to-day operational <br /> responsibility within the CITY. <br /> 4. On activation of the CITY's Emergency Operations Center (EOC), the individuals designated <br /> by the CITY Manager and the Division Chief shall be detailed to assist in EOC operations and release of <br /> local resources may occur only after their evaluation of local conditions. <br /> V.
