Subcontractors' employee, who has, or will have, Jobsite access, has been <br />convicted of a serious criminal offense. <br />7.2.2 Visitor Badge Requirement All visitors to a particular Jobsite must comply <br />with that Jobsite's visitor access requirements. <br />7.3. Sexual Harassment: SCE supports a diverse work force and prohibits unlawful <br />employment discrimination and harassment of every kind, including sexual <br />harassment, in accordance with state and federal laws. Whenever present on SCE <br />property or facilities, Implementer shall require its employees, Subcontractors, agents <br />to comply with all applicable federal and state statutes, acts, regulations, codes and <br />standards prohibiting conduct that might reasonably be construed as violating state or <br />federal equal opportunity laws, including conduct such as making sexually suggestive <br />jokes or remarks, touching, assaulting, making gestures of a sexual or suggestive <br />nature, and impeding or blocking any SCE employee's, subcontractor's or agent's <br />movement. <br />8. DOUBLE DIPPING PROHIBITED <br />8.1 If, in performing its respective Work obligations, Implementer engages contractors <br />or vendors who provide incentives or services to SCE customers, Implementer shall <br />take all appropriate steps to minimize double-dipping. As applicable: <br />Prior to providing incentives or services to any eligible customer, Implementer shall <br />require its subcontractors to obtain a signed form from such eligible customer stating <br />that: <br />8.1.1. Such eligible customer has not received incentives or services for the <br />same measure from any other SCE program or from another utility, <br />state, or local program. <br />8.1.2. Such eligible customer agrees not to apply for or receive Incentives or <br />services for the same measure from any other SCE program or from <br />another utility, state, or local program. <br />Each Party shall keep its customer-signed forms for at least five (5) years <br />after the expiration or termination of this Contract. <br />No Party shall knowingly provide an incentive to a Participating Municipality, or make <br />payment to a subcontractor who is receiving compensation for the same product or <br />service either through another ratepayer funded program, or through any other funding <br />source. <br />9. REPORTING/EM&V <br />9.1 Reporting. The Parties shall implement all reporting requirements set forth in the <br />Statement of Work, including Appendix A and B of the Statement of Work. The <br />reporting requirements set forth in such Appendix B will be amended when issued by <br />the Commission for the 2010-2012 program cycle, and may be amended from time to
