City of Santa Ana <br />Environmental Checklist <br />materials could be unearthed during excavation and trenching activities associated with the <br />proposed project. Therefore, construction of the proposed project may have the potential to disturb <br />and destroy an unknown paleontological resource. Disturbance of any unknown buried <br />paleontological resources could result in an adverse impact. Therefore, implementation of <br />Mitigation Measure CR-2 would reduce the potentially significant impact to a less-than-significant <br />level. <br />Mitigation Measure CR-2: During grading excavation and trenching, the contractor will be <br />responsible for notifying the City in the event that suspected paleontological resources are <br />discovered. The City will require the applicant to retain a qualified professional paleontological <br />monitor to assess the find, identify treatment options, and oversee further excavation and trenching. <br />The qualified paleontological monitor will retain the option to reduce monitoring if, in his or her <br />professional opinion, the sediments being monitored were previously disturbed. Monitoring may <br />also be reduced if potentially fossiliferous units are not present or, if deposits are present, they are <br />determined by qualified paleontological personnel to have a low potential to contain fossil <br />resources. The monitor will be equipped to salvage fossils and samples of sediments as they are <br />unearthed to avoid construction delays and will be empowered to temporarily halt or divert <br />equipment to allow removal of abundant or large specimens. Recovered specimens will be prepared <br />to a point of identification and permanent preservation, including washing of sediments to recover <br />small invertebrates and vertebrates. Specimens will be curated into a professional, accredited <br />museum repository with permanent retrievable storage. A report of findings, with an appended <br />itemized inventory of specimens, will be prepared and will signify completion of the program to <br />mitigate impacts on paleontological resources. <br />d. Disturb any human remains, Including those interred outside of formal cemeteries? <br />No Impact. The project site is not a formal cemetery and is not near a formal cemetery. The project <br />vicinity is fully developed, and there is no record of human remains being identified during <br />development of the area. In addition, the site is not known to be located on a burial ground. <br />Therefore, it is highly unlikely the proposed project would disturb any human remains during <br />construction. Should human remains be uncovered during construction, as specified by State Health <br />and Safety Code Section 7050,5, no further disturbance will occur until the County Coroner has <br />made the necessary findings as to origin and disposition pursuant to Public Resources Code <br />5097.99. If such a discovery occurs, excavation of, construction will halt in the area of the discovery, <br />the area will be protected, and consultation and treatment will occur as prescribed by law. If the <br />County Coroner recognizes the remains to be Native American, he or she will contact the Native <br />American Heritage Commission, who will appoint the Most Likely Descendent. Additionally, if the <br />bones are determined to be Native American, a plan will be developed regarding the treatment of <br />human remains and associated burial objects, and the plan will be implemented under the direction <br />of the Most Likely Descendent.
