ARTICLE X <br />10.0 OTHER LEAVES OF ABSENCE <br />10.1 Sick Leave. <br />A. Definition. Except as otherwise provided below, sick leave shall be deemed to <br />mean absence fiom duty of an employee because of illness, injury, medical, or <br />dental appointment that prevents the employee from performing the duties of his <br />or her position, and shall be deemed to include time in quarantine resulting from <br />exposure to a contagious disease. <br />B. Accrual. Each employee shall be entitled to, and shall earn, one (1), eight (8) <br />hour working day of sick leave for each full calendar month of service in which <br />he is employed by the City with full pay; provided, however, any absence on sick <br />leave for a period of time greater than fifteen (15) consecutive calendar days in <br />any one (1) calendar month shall not be considered to be service entitling an <br />employee to earn sick leave as aforesaid. Subject to the other provisions in this <br />Article, sick leave shall accrue to the credit of each employee to the extent that it <br />is not used. <br />C. Authorized Only When Necessary. Use of sick leave by City employees shall be <br />authorized as follows: <br />1. Sick leave is not a right which an employee may use at his or her <br />discretion, but shall be allowed only in cases of necessity and actual <br />sickness or disability, or as authorized in Subsection J below. <br />2. When an accepted industrial illness or injury has caused an employee's <br />absence, for which benefits are required under the State Workers' <br />Compensation Insurance and Safety Act, paid sick leave will be allowed <br />such employee during the first three (3) days of the statutory waiting <br />period. If the workers' compensation related illness or injury continues <br />past the initial three (3) consecutive days, the employee will have the three <br />(3) used sick days re-credited to his or her account, if the employee <br />remains off work longer than 14 days. Paid sick leave will continue until <br />the fourth (01) day when the City pays the employee workers' <br />compensation benefits for such illness or injury. If the employee does not <br />have sufficient accumulated sick leave at the commencement of such <br />industrial illness or injury, they will be advanced sick leave for this <br />purpose. Subsequently, the City will deduct an equal amount previously <br />advanced from any sick leave accrued by the employee until the total <br />amount is recovered. If the employee terminates before recovery of all <br />advanced sick leave, the City will deduct the unrecovered cost of sick <br />43 <br />25B-83
