Conditional Use Permit No. 2004 -24 <br />November 22, 2004 <br />Page 1 of 1 <br />Findings of Fact <br />A. Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />community? <br />The proposed private health facility for the Geneva Commons <br />project will provide a service to the residents by making <br />fitness equipment and community meeting space available for the <br />future tenants. Conditions of approval have been included to <br />ensure the facilities are available for the homeowners only. <br />B. Will the proposed use under the circumstances of the particular case <br />be detrimental to the health, safety, or general welfare of persons <br />residing or working in the vicinity? <br />The proposed health facility will not be detrimental to persons <br />residing and working in the area as the use will not create any <br />negative or adverse impacts but will provide an additional <br />amenity to the Geneva Commons development. <br />C. Will the proposed use adversely affect the present economic <br />stability or future economic development of properties surrounding <br />the area? <br />The proposed facility will be situated within the Geneva <br />Commons development. This amenity will reinforce the economic <br />viability of the project and will assist in identifying the <br />project as a viable residential community. <br />D. Will the proposed use comply with the regulations and conditions <br />specified in Chapter 41 for such use? <br />The project will be in compliance with all applicable <br />provisions of Chapters 34 and 41 of the Santa Ana Municipal <br />Code as well as the provisions of the SD -43 zoning district. <br />E. Will the proposed use adversely affect the General Plan or any <br />specific plan of the City? <br />The proposed project will not adversely affect the General Plan <br />as residential development and ancillary uses are permitted <br />within the District Center (DC) general plan designation. <br />CUP 04 -24 /DA 04 -31TTM 04 -5 <br />SPR 04 -6NA 04- 11/ZOA 04 -5 <br />EXHIBIT 13 <br />
