ALUU Minutes <br />Page 3 <br />December 18, 2003 <br />Mr, Brady related his conversation with the FAA manager, who signed the Determination and who <br />stated that had an impact on JWA been found, FAA would have asked the developer to lower the <br />building, before issuing any decision. He described in detail his prior experience with the FAA and the <br />tallest office building in Towne Center, Costa Mesa, during the mid -1980$ when the FAA and the <br />developer negotiated and reached a compromise on the structure's design to a maximum height above <br />ground, thereby avoiding a hazard Determination, The FAA did modify a seldom used aircraft <br />procedure, while announcing it would not do so again. <br />Replying to Commissioner Propst, Mr. Brady explained that JWA does not own the airspace, under the <br />1964 Irvine Company avigation easement purchase, above the project site; and he confirmed that <br />commercial jetliners are the primary users of Runway 19R. <br />Conunissioner Ptopst described a typical ILS approach to Runway 19R, asking about the project's <br />Proximity to an acceptable flight envelope for that procedure and for a missed - approach with a go- <br />around, <br />Mr, Brady cited the FAA's figures that the project is about .6 mile perpendicular from a point on the <br />extended centerline, 6,200' outward from the end of 19R, <br />Commissioner Propst likened the project to the parking structure beneath the approach to Lindbergh <br />Field, noting that although apparently technically consistent, the project is in a bad location, <br />Mr. Brady referred him to the specific project site shown on the radar track graphic. <br />Commissioner Campbell stated her concern with the altitudes of arriving aircraft and the project's <br />height, asking whether there are similar high -rise residential buildings this close to the runway. <br />Mr. Brady repeated that the combination of location, height and use make this an unprecedented project, <br />although he knows of similar projects being proposed nearby, <br />Commissioner Campbell stated her strong concerns with the project's proximity to JWA. She noted <br />from the radar graphic that aircraft will over -fly the site on approach to 19R, while observing that the <br />loss of El Toro airspace will put more demand on JWA.. She added that aircraft are not as <br />maneuverable as some may think, especially during windy conditions, and putting people under the <br />approach does not protect them or the airport, <br />Mr. Brady confirmed that the ALUC has reviewed numerous low -rise residential projects near JWA <br />during the year, the current project being different from those, <br />Commissioner Webb queried whether there is any ALUC policy or basis to deny the project? <br />Chairman Bresnahan noted that the A.LVC has responsibility to interpret the facts, including the facts <br />pertaining to various Commissioners' cancers, such as noise impact on residents in a high -rise and the <br />possible effect on the navigable airspace. He concurred that previous ALUC reviews covered projects <br />to the sides of the airport, whereas the current project is unique in being the first one near the approach <br />corridor.
