09/19/00 <br />EXHIBIT A <br />DELHI COMMUNITY CENTER <br />Standard Exclusions and Clarifications <br />Footnotes to Guaranteed Maximum, Price Contract <br />Introductinn <br />All patties in this Agreement acknowledge, at the time of execution of this Contract, specific plans and <br />specifications for the intended Work have not been developed. This exhibit serves to outline the general <br />understanding of the pro ject contemplated. All parties shall endeavor to direct the design and <br />construction documentation in a cooperative effort to achieve the Guaranteed Maximum Price stated <br />herein. This Guaranteed Maximum Price is valid for a period of 30 days. <br />I. Contractors Contingency: <br />The Contractors Contingency is established at $97,575, as shown in Exhibit C. Such <br />Contingency shall be under the control of the Contractor for unforeseen, and/or unanticipated <br />costs or problems, which would not ordinarily be extras to the Contract. The Contractors <br />Contingency shall only be adjusted, based upon actual costs, at the conclusion of the project. Cost <br />adjustments that result in savings on individual line items, shall remain as increased Contractors <br />Contingency until mutually released by the Owner and Contractor. Cost adjustments that result <br />in overruns, on individual line items, may use cost savings from other litre items to offset such -- <br />cost overruns. Unused portions of the Contractors Contingency shall be returned to Owner, upon <br />project completion, and after all owed amounts are paid by the Contractor for Contractors costs, <br />including the various Suppliers, Subcontractors, and Materialmen, labor, eta <br />?, Change Orders: <br />Change Orders less than $250,000.00, which exceed the overall Gwitrizead Maximum Price_- - <br />(GMP), if any, will receive a 10% Contractors feo, and .96% for Liability Insurance. Change <br />Orders greater than $250,000.00, which exceed the overall Guaranteed Maximum Price (GNfP), it <br />any, will receive a 6% Contractors Fee. Cost savings, if any, shall not adversely affect the <br />Contractors right to obtain additional tec for additional work. Contractor shall not be penalized <br />change order fee due to cost savings. <br />3. Excluded Items: <br />The following items are NOT included in the GM? Budget Estimate, and shall be at the cost of <br />the Owner. <br />Grading Permits <br />• Building Permit <br />• Plan Check Fees <br />Construction Permits <br />Special Permits <br />• Permits for operation in or on Public Streets <br />Inspection Costs <br />Right of Way Permits <br />• Deputy Inspectors <br />• Testing Costs <br />Roof Consultant & Tasting <br />• Builders Risk Insurance <br />• Utility Company connection fees and assessments <br />• Sewer District Charges <br />• School District Charges <br />Environmental Impact Pees <br />F 0..saciecreoe=4u1u.� w� 1 <br />
