Section 8 <br />information relevant to Native American sites in the project area and advised <br />BonTerra/ Psomas to contact various local tribes. The NAHC provided a list of <br />tribes affiliated with the project site. Each tribe on the list was notified in writing <br />on June 8, 2015, of the Proposed Project and was invited to provide any <br />information they could have regarding cultural resources on or near the project <br />area. No responses were provided indicting the potential presence of Native <br />American scared burial grounds. <br />Even though there is low potential for discover of Native American sacred burial <br />grounds, there would be some potential that unknown Native American sacred <br />burial grounds could be encountered during earthwork activities. With the <br />impllementation of Mitigation Measure CR-2 potential adverse impacts to <br />unknown Native American sacred burial remains would be reduced to a less than <br />significant level!. <br />Mitigation Measure <br />CR-2: If human remains are encountered during excavation activities, all work <br />shall halt in the vicinity of the remains and the County Coroner shall be notified <br />(California Public Resources Code §5097.98). The Coroner will determine <br />whether the remains are of forensic interest. If the Coroner, with the aid of a <br />qualified Archaeologist, determines that the remains are prehistoric, s/he will <br />contact the Native American Heritage Commission (NAHC). The NAHC will be <br />responsiible for designating the most likely descendant (MLD), who will be <br />responsible for the Ultimate disposition of the remains, as required by Section <br />7050.5 of the California Health and Safety Code. The MLD shall make his/her <br />recommendation within 48 hours of being granted access to the sites. If feasible, <br />the recommendation of the MLD shall be followed and may include scientific <br />removal and non-destructive analysis of the human remains and any items <br />associated with Native American burials (California Health and Safety Code <br />§7050.5). If the landowner rejects the recommendations of the MILD, the <br />landowner shall rebury the remains with appropriate dignity on the property in a <br />location that will not be subject to further subsurface disturbance (California <br />Public Resources Code §5097.98). <br />Level of Impact <br />Less than significant impact with Mitigation Measure CR-2 <br />83 Federal Clean Air <br />Air Basin: South Coast Air Basin <br />Local Air District: South Coast Air Quality Management District <br />k,j Mid Basin Centennial Park J rt ry Project Final EIR 8 11 <br />
