Psomas will review and make recommendations to the City to <br />ensure that any policies established related to the collection of delinquent Special <br />Assessments are consistent with the foreclosure covenant and/or with the <br />requirements of the District formation documents, <br />* Delinquency History. Psomas will maintain a database that includes a delinquency <br />history of the parcels, as derived from the County property tax system. Delinquency <br />history will include delinquent amounts for each parcel including reference to those <br />parcels that have been referred to Foreclosure Counsel, and prior year delinquencies <br />that have been paid. <br />* Delinquency Tracking and Reporting. Psomas will research the records of the County <br />Tax Collector for payment information to determine which parcels are delinquent after the <br />December 10 and April 10 property tax installment due dates, after June 30 and prior to <br />the date in which the City is obligated to initiate foreclosure proceedings under the <br />foreclosure covenant. Delinquency reports will include parcel lists showing the Assessor <br />Parcel Numbers, property owner and delinquent amount for each parcel. <br />* Notification to Delinquent Property Owners. At the request of the City, Psomas will <br />prepare letters to property owners at the times and in the format determined by the <br />delinquency policy. Psomas will respond to public requests regarding delinquent notices <br />and will prepare, as necessary, statements to the requesting party of all amounts delinquent <br />including penalties, interest, and roll removal fees. <br />* Removal from Rolls. Psomas will prepare correspondence to the Auditor's Office for <br />removal of delinquent Special Taxes or Special Assessments from the tax rolls in the event <br />these amounts are paid directly to the District. The City will pay for any County required <br />fees. <br />Foreclosure Coordination. Psomas will provide delinquent amounts (including penalty <br />and interest) to Foreclosure Counsel in the event that foreclosure proceedings are initiated. <br />Direct Payments. Psomas will coordinate direct collections of individual delinquencies and <br />deposits with the Fiscal Agent. <br />City Support Responsibilities <br />Psomas will coordinate with City staff to create a partnership to facilitate successful <br />project completion. We will rely on the City to provide the following information <br />including, but not limited to: <br />* Adopt a resolution setting the public hearing for the District <br />* Direct the City Clerk to set the date and publish a notice for the Public hearing <br />* Conduct public hearing <br />55B-148 <br />
