NOW THEREFORE, inconsideration of the mutual and respective promises, and subject <br />to the terms and conditions hereinafter set forth, the parties agree as follows: <br />1. Pursuant to said Agreement as hereby amended, "COMPENSATION" shall be as <br />follows: <br />City agrees to pay, and Bank agrees to accept as total payment for its <br />services, the rates and charges (`BANK FEES ") identified in Exhibit A. The <br />total sun to be expended for the period from January 1, 2016 through June 30, <br />2016 shall not exceed $22,500.00. The total sum to be expended under the <br />additional option period shall not exceed $22,500.00. <br />2. Pursuant to said Agreement as hereby amended, "TERM" shall be as follows: <br />This Amendment to Agreement shall commence on January 1, 2016 and <br />terminate on June 30, 2016, unless City Manager and City Attorney exercise <br />City's option to extend the Agreement for an additional s i x ( 6 ) m o n t h <br />period ending December 31, 2016, or unless terminated earlier in accordance <br />with said Agreement. <br />3. Pursuant to said Agreement as hereby amended, `BANK FEES" shall be as follows: <br />All bank fees will remain the same as those described in Bank's City of <br />Santa Ana account analysis statements for the month of September 2015 <br />(subject to increases in deposit insurance assessments, which will be passed <br />through to City as and when incurred). <br />{Signatures on following page} <br />
