jmf 412118 <br />RESOLUTION NO. 2018 -XXX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA APPROVING THE RELOCATION PLAN <br />FOR PHASE 1 IMPROVEMENTS OF THE WARNER <br />AVENUE IMPROVEMENTS PROJECT BETWEEN MAIN <br />STREET AND OAK STREET <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. Warner Avenue is a major east -west transportation facility, which is <br />designated as a major arterial highway in the City of Santa Ana's Circulation Element <br />of the General Plan. Improving the 1 -mile Warner Avenue segment from Main Street <br />to Wright Street has been a long-term priority project that is being constructed in <br />several phases. <br />B. Effective July 1, 2016, the City Council approved a cooperative <br />agreement between the City and the Orange County Transportation Authority for the <br />widening of Wanner Avenue between Main Street and Oak Street. <br />C. The M2 CTFP Master Funding Agreement (No. C-1-2783), as amended, <br />committed OCTA to contribute funding for various phases of the Warner Avenue <br />widening project. <br />D. The Public Works Agency is acquiring property for development of <br />Phase 1, bounded by Main Street and Oak Street, and expects to complete the right- <br />of-way acquisition process by fall 2018. Construction is anticipated to begin in spring <br />2019. <br />E. Pursuant to California Government Code section 7260, et seq., a public <br />entity is required to adopt a relocation plan, by resolution, whenever it enters into an <br />agreement for acquisition of real property or an agreement for the disposition and <br />development of property that would lead to displacement of people from their homes. <br />F. Section 6002 and 6038 of the California Code of Regulations, Title 25, <br />Chapter 6, et seq., requires the adoption of a Relocation Plan due to the displacement <br />of residential and business occupants. <br />G. A relocation plan has been prepared in conformance with applicable <br />provisions of the California Government Code section 7260, et seq., and the <br />Relocation Guidelines, California Code of Regulations, Title 25, Chapter 6, and has <br />-been made available for public review since March 5, 2018.
