City of Santa Ana Addendum to the <br />MainPlace Mall Transformation Project Fashion Square Commercial Center Final EIR <br />effects, or a substantial increase in the severity of previously identified significant <br />effects; or <br />New information of substantial importance that was not known and could not have <br />been known with the exercise of reasonable diligence at the time the previous EIR <br />was certified or the negative declaration was adopted shows any of the following: <br />A. The project will have one or more significant effects not disclosed in the <br />previous EIR or negative declaration. <br />B. Significant effects previously examined will be substantially more severe <br />than identified in the previous EIR. <br />C. Mitigation measures or alternatives previously found not to be feasible <br />would in fact be feasible and would substantially reduce one or more <br />significant effects of the project, but the project proponent declines to adopt <br />the mitigation measures or alternatives. <br />D. Mitigation measures or alternatives that are considerably different from <br />those analyzed in the previous EIR would substantially reduce one or more <br />significant effects on the environment, but the project proponent declines to <br />adopt the mitigation measures or alternatives. <br />If some changes or additions to the previously prepared EIR or negative declaration are <br />necessary, but none of the conditions specified in State CEQA Guidelines section <br />15162 are present, the lead agency shall prepare an addendum. <br />In reviewing this Addendum, the question before the City decisionmakers is not whether <br />the previous EIR complies with CEQA, but only whether one of the events triggering the <br />need for subsequent environmental review has occurred. (A Local & Regional Monitor V. <br />City of Los Angeles (1993) 12 Cal.AppAth 1773; Committee for Green Foothills v. <br />Santa Clara County Board of Supervisors (2010) 48 CalAth 32.) <br />Pursuant to State CEQA Guidelines section 15164(b), an addendum to a previously <br />certified EIR is not circulated for public review; but is considered by the Lead Agency in <br />making a decision about the project. <br />1.3 SUMMARY OF CEQA ANALYSIS <br />In accordance with the State CEQA Guidelines, the City of Santa Ana completed a <br />comprehensive analysis of the MainPlace Mall Transformation Project and found that <br />none of the conditions specified in CEQA Guidelines Section 15162 are present. <br />Accordingly, an Addendum to the previously certified 1983 EIR is the CEQA-required <br />form of environmental review for the proposed Project. <br />Pursuant to CEQA and the State CEQA Guidelines, the City's review of this Addendum <br />focuses on the potential environmental impacts associated with the MainPlace Mall <br />Transformation Project that might cause a change in the conclusions of the certified <br />1983 EIR, including changes in circumstances or new information of substantial <br />G <br />
