City of Santa Ana Addendum to the <br />MainPlace Mall Transformation Proiect Fashion Square Commercial Center Final EIR <br />be less than significant from implementation of the Project as a result of compliance <br />with existing law. Also, trees in the public right-of-way in Santa Ana are protected under <br />Chapter 33, Article VII of the Municipal Code, which regulates the planting, <br />maintenance, and removal of trees in public locations in the City. The Project site <br />contains existing ornamental trees that are on private property and not subject to the <br />City ordinance. Should any of the existing trees in the public right-of-way be removed <br />and/or replaced as part of implementation of the Project, the City's permitting process <br />would provide compliance with Chapter 33, Article VII of the Municipal Code. Therefore, <br />implementation of the proposed Project would not conflict with local polices or <br />ordinances protecting trees and no new impact would occur. <br />As required by the 1983 EIR and 1996 Addendum, a landscape plan has been <br />developed for the proposed Project that defines specific planting zones for various <br />areas onsite. As buildings on the site are developed, the permitting process includes <br />approval of specific landscape plans for landscaped buffers along roadways, between <br />onsite buildings, and in parking lots. The proposed landscaping includes trees, shrubs, <br />and ground covers that comply with the City's water efficient landscape, drip irrigation, <br />and tree planting standards. No new impact would occur. <br />Conclusion for Biota <br />Consistent with the determinations of the 1983 EIR and 1996 Addendum, impacts <br />related to biota from implementation of the proposed Project would be less than <br />significant. Thus, no new or substantially greater impacts would occur with <br />implementation of the proposed Project when compared to those identified in the 1983 <br />EIR or 1996 Addendum. <br />Based on the foregoing, none of the conditions identified in CEQA Guidelines section <br />15162 that would trigger the need to prepare a subsequent or supplemental EIR or <br />other environmental document to evaluate Project impacts or mitigation measures exist <br />regarding biota. There have not been 1) changes to the Project that require major <br />revisions of the previous adopted EIR due to the involvement of new significant <br />environmental effects or a substantial increase in the severity of previously identified <br />effects; 2) substantial changes with respect to the circumstances under which the <br />Project is undertaken that require major revisions of the previous adopted EIR due to <br />the involvement of new significant environmental effects or a substantial increase in the <br />severity of previously identified effects; or 3) the availability of new information of <br />substantial importance relating to significant effects or mitigation measures or <br />alternatives that were not known and could not have been known when the 1983 EIR <br />was adopted as completed. <br />Mitigation Measures <br />The mitigation measure from the 1983 EIR is listed below. Explanation is provided as to <br />the status and applicability of the measure.
